Chapter 13 - New York Eastern Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1.a – Limit on Secured Claim Amount

  • If there are any claims being added for § 3.4, this section will be marked as Included.

  • If there are no claims being added for § 3.4, this section will be marked as Not Included.


§ 1.1.b – Lien Avoidance

  • If there are claims being added for § 3.4, this section will be marked as Included.

  • If there are no claims being added for § 3.4, this section will be marked as Not Included.


§ 1.2.b – Unsecured Creditors Distribution

  • If the unsecured percentage is 100%, this section will be marked as Included.

  • If the unsecured percentage is less than 100%, this section will be marked as Not Included.


§ 3.1 – Maintenance of Payments List any secured mortgage claims where the treatment is to pay outside the plan. If there are no such claims, this section will indicate "None."


§ 3.2 – Cure of Default List any secured real estate or vehicle arrearage claims where the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."


§ 3.4 – Request for Valuation of Security, Modification of Under-Secured Claims, and Lien Avoidance List any secured claims where the box is selected for "506." If there are no such claims, this section will indicate "None."


§ 3.5 – Secured Claims on Real or Personal Property to be Paid in Full Through the Trustee List any secured claims that are not mortgages where the box is selected for "910." If there are no such claims, this section will indicate "None."


§ 3.6 – Surrender of Collateral List any secured claims where the intent is to surrender. If there are no such claims, this section will indicate "None."


§ 4.4 – Priority Claims Other Than Attorney's Fees List any priority claims where the type is NOT a Domestic Support Obligation. If there are no such claims, this section will indicate "None."


§ 4.5 – Domestic Support Obligations List any priority claims where the type is Domestic Support Obligation. If there are no such claims, this section will indicate "None."


§ 6.1 – Executory Contracts and Unexpired Leases List any lease claims where the intent is to assume. Current installment payments will be paid directly by the debtor and arrearage payments will be disbursed by the Trustee. All other executory contracts and unexpired leases are rejected. If there are no such claims, this section will indicate "None."
