Chapter 13: Alaska Instructions

All of our Chapter 13 Plans have merge tags that pull information from your case directly into your plan. Each tag has a set of instructions, which describe the logic within the app, so that you can easily understand how this tag is populated. Below is a list of your plan specific tags with their corresponding instructions.

§ 1.1 — Does the Plan Seek to Limit a Secured Claim?

This checkbox indicates whether the plan seeks to limit the amount of a secured claim under § 3(e) (Modified Secured Claims).

  • If there are any claims entered in the Modified Secured Claims section (§ 3(e)), the system will mark Included.

  • If there are no claims in that section, the system will mark Not Included.


§ 1.2 — Does the Plan Contain Non-Standard Provisions?

This checkbox indicates whether the plan includes any non-standard provisions in Part 6.

  • If there are no claims entered in the Modified Secured Claims section (§ 3(e)), the system will mark Not Included.

  • If there are claims entered in that section, the system will mark Included.


§ 3(b) — Domestic Support Obligations

This section lists all domestic support obligation (DSO) claims. For each DSO claim, the plan will include the creditor's name and the monthly payment amount.


§ 3(d)(i) — Cure of Arrearage: Residential Mortgage

This section lists all secured real property arrearage claims where the intent is not to surrender or avoid the lien, and the treatment is to pay the arrearage inside the plan. For each claim, the plan will include:


§ 3(d)(ii) — Cure of Arrearage: Other Secured Claims

This section lists all other secured claim arrearages (non-real property) where the intent is not to surrender or avoid the lien, and the treatment is to pay the arrearage inside the plan. For each claim, the plan will include:


§ 3(e) — Modified Secured Claims

This section lists all secured claims where the intent is not to surrender or avoid, the treatment is "506," and the claim is set to pay inside the plan. For each claim, the plan will include:


§ 3(f) — Secured Claims Not Modified (910 Vehicle Claims)

This section lists all secured claims where the 910 vehicle exclusion is selected and the treatment is to pay inside the plan. For each claim, the plan will include:

  • Creditor name

  • Collateral

  • Estimated balance

  • Number of payments (the amortized balance divided by the monthly payment, rounded up to the nearest whole number)

  • Estimated monthly payment

  • Interest rate


§ 3(g) — Priority Unsecured Claims: Taxes

This section lists all priority unsecured claims where the type is Taxes & Other Government Units. For each claim, the plan will include:


§ 4.1(a) — Secured Claims Paid Outside the Plan: Residential Mortgage

This section lists all real property mortgage claims on the debtor's residential property where the intent is not to surrender or avoid, and the treatment is to pay outside the plan. For each claim, the plan will include:


§ 4.1(b) — Secured Claims Paid Outside the Plan: Other

This section lists all other secured claims (non-residential) where the intent is not to surrender or avoid, and the treatment is to pay outside the plan. For each claim, the plan will include:


§ 4.2 — Surrender of Collateral

This section lists all secured claims where the intent is to surrender the collateral. For each claim, the plan will include the creditor name and the collateral being surrendered.


§ 5 — Executory Contracts and Unexpired Leases

This section lists all lease and executory contract claims. For each contract or lease, the plan will display the creditor name and indicate whether it is assumed or rejected:

  • If the intent is to assume the lease, the Assumed box will be marked.

  • If the intent is to reject the lease, the Rejected box will be marked.


Plan Analysis — Estimated Distributions to Creditors

The Plan Analysis automatically calculates and populates the following totals based on claims entered in the plan:

  • § 3(d)(i) Residential Mortgage Arrears Total — the sum of all arrearage balances listed in the Cure of Arrearage: Residential Mortgage section.

  • § 3(d)(ii) Other Arrears Total — the sum of all arrearage balances listed in the Cure of Arrearage: Other Secured Claims section.

  • § 3(e) Total Distributions — Modified Secured Claims — the sum of all balances listed in the Modified Secured Claims section.

  • § 3(f) Total Distributions — Unmodified Secured Claims — the sum of all balances listed in the 910 Vehicle Claims section.


Plan Analysis — Disposable Income Distribution Analysis

This section is determined by which line is checked on Form 122C-1, Line 17.

  • If Line 17a is checked (disposable income determined under § 1325(b)(3)), the top portion of the table will be completed and that box will be marked. The table will pull the total distributions to unsecured claims (divided by 60) and the monthly disposable income from Form 122C-2, Line 45.

  • If Line 17b is checked (disposable income not determined under § 1325(b)(3)), the bottom portion of the table will be completed and that box will be marked. The table will pull the total distributions to unsecured claims (divided by the plan length), along with the following figures:

    • Current Monthly Income from Form 122C-1, Line 20

    • Support Income from Form 122C-2, Line 40

    • Qualified Retirement Deduction from Form 122C-2, Line 41

    • Monthly Expenses from Form 106J, Line 22

    • Payroll Deductions from Form 106I, Line 6

    • Calculated Monthly Disposable Income


Plan Analysis — Liquidation Analysis: Non-Exempt Equity

This section populates two values in the Liquidation Analysis:

  • Non-exempt equity in real property — the total unexempt amount for real property. If the calculated amount is negative, the plan will display $0.00.

  • Non-exempt equity in personal property — the total unexempt amount for personal property. If the calculated amount is negative, the plan will display $0.00.


Plan Analysis — Schedule of Direct Payments

This section lists all secured claims, lease agreements, and domestic support obligations that are being paid inside the plan and do not have an intent to surrender or avoid. For each entry, the schedule will include:

  • Creditor name

  • Nature of claim (for priority claims: the type; for secured claims: the nature of the lien; for executory contracts: the type of lease)

  • Estimated balance

  • Number of payments (equal to the plan length)

  • Monthly payment

  • Due date


Plan Analysis — Monthly Income and Expenses: Difference Line

This line calculates the difference between the debtor's monthly income (from Schedule I) and monthly expenses (from Schedule J). It reflects the net monthly amount available after expenses.
