We are often asked many of the same questions from attorneys prior to purchasing Virtual Paralegal for the first time. Below we have made a list of those frequently asked questions.
*Please note that all work done by the paralegal is based on the attorney's preference. Once you purchase your first case, the paralegal will then reach out to set up an introduction call. The introduction call is our way for you to get one on one time with the paralegal to discuss everything from workflow to work expectations.
Q: Will I be assigned a virtual paralegal who is familiar with my district?
A: Yes, we make sure you are paired with a VP that is familiar with your district and local rules. Every detail of the case is taken into consideration when assigning a VP to your casework.
Q: What happens if I need to convert the chapter before filing and after hiring a VP?
A: If you are unsure if a case will qualify as a chapter 7 or 13, you can purchase the case as a chapter 7 to start. If a case can't proceed as a 7 and you can change the case to a chapter 13 at any time. There is no additional fee to change the case to a chapter 13 unless you would like the paralegal to assist with preparing the chapter 13 plan.
Q: Does the VP reach out to the client on behalf of my firm or do they say they are a hired virtual paralegal?
A: The virtual paralegal works under your direct supervision. When they contact your client, they will always introduce themselves as the paralegal working on behalf of your firm.
Q: What if I want to use a different paralegal?
A: If you are wanting to use a different VP moving forward with your casework, we ask that you please reach out to us letting us know so we can make sure to get it updated on our end prior to new purchases.
Q: If something needs to be amended after the case has been filed is that included in the initial filing fee?
A: Post-petition work such as amendments and supplemental filings are not included. After the case is filed, if the firm would like assistance from a virtual paralegal to prepare and file amendments, submit your request to paralegal@nextchapterbk.com including case name and additional work needed.
Q: What happens if the case is inactive due to the client not supplying information?
A: If the case is inactive for more than 3 months the paralegal will reach out to you and let you know that the case will be placed on hold until the client can produce further information and/or there is new activity in the case.
Q: Is there an additional fee other than the flat fee for virtual paralegal services? A: The fee for virtual paralegal services only includes the help of a paralegal and it does not include the fee to use the software. Your firm is still charged to use the software, either on a per case or annual fee and for any added service you use such as pulling credit reports.
Q: How long does a case normally take the VP to complete from start to finish? A: Completing a case from start to finish depends on how fast and proactive the client is with providing the necessary documents and information. The paralegals are skilled in following up with the client to get the necessary information to prepare the case, however, this is the part of the process that usually takes the longest, especially if the client isn't responsive or quick to reply.
Q: If the client no longer decides to file for bankruptcy? Am I entitled to a refund or partial credit?
A: Per our Service Agreement we do not issue refunds. We always suggest that the firm waits until the client's fees are paid in full prior to hiring a VP. Since the paralegals are self contracted, they are entitled to be compensated for their work and time with the case.
Q: Whose job is it to keep up with the VP to make sure they are following up with the client?
A: When it comes to managing the VP's work, it falls back onto the attorney. Once the VP is hired they are then under your supervision. That is why we make it a point to complete the introduction call. That way you have the opportunity to discuss your workflow with the VP.
