Chapter 13: Washington Western District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ I.B – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § IV.C.10(b).

  • If you have added claims under § IV.C.10(b), the plan will reflect Yes.

  • If you have no claims under § IV.C.10(b), the plan will reflect No.


§ II – Means Test Result and Plan Duration This section is controlled by the means test result.

  • If there is no presumption of abuse, the plan will reflect that the debtor is a below median income debtor with a 36 month applicable commitment period.

  • If there is a presumption of abuse, the plan will reflect that the debtor is an above median income debtor with a 60 month applicable commitment period.


§ IV.B – Ongoing Domestic Support Obligations List any domestic support obligation claims where the treatment is to pay inside the plan. For each claim, enter the creditor name and monthly payment amount.


§ IV.C.8 – Principal Residence Mortgage — Ongoing Payments List all secured claims attached to the debtor's residential property where the intent is not to surrender and the treatment is to pay conduit. Do not list arrearage claims here. For each claim, enter the monthly payment amount, creditor name, and collateral description.


§ IV.C.8 – Principal Residence Mortgage — Cure Payments List all arrearage claims attached to the debtor's residential property where the intent is not to surrender and the treatment is to pay inside the plan. For each claim, enter the monthly payment on the arrearage, creditor name, collateral description, arrearage balance, and interest rate.


§ IV.C.9 – Other Real Property — Ongoing Payments List all secured claims attached to real property that is not the debtor's residential property where the intent is not to surrender and the treatment is to pay conduit. Do not list arrearage claims here. For each claim, enter the monthly payment amount, creditor name, and collateral description.


§ IV.C.9 – Other Real Property — Cure Payments List all arrearage claims attached to real property that is not the debtor's residential property where the intent is not to surrender and the treatment is to pay inside the plan. For each claim, enter the monthly payment on the arrearage, creditor name, collateral description, arrearage balance, and interest rate.


§ IV.C.10(a) – 910 Claims — Personal Property List all secured claims attached to personal property where the intent is not to surrender and the treatment is to pay inside the plan and the secured balance is the same as the balance on Schedule D. For each claim, enter the monthly payment, creditor name, collateral description, pre-confirmation adequate protection payment amount (if applicable), and interest rate.


§ IV.C.10(b) – Non-910 Secured Claims — Personal Property List all secured claims attached to personal property where the intent is not to surrender and the treatment is to pay inside the plan and the secured balance is less than the balance on Schedule D. For each claim, enter the monthly payment, creditor name, collateral description, pre-confirmation adequate protection payment amount (if applicable), and interest rate.


§ IV.E – Nonpriority Unsecured Claims This section is controlled by the estimated unsecured creditor distribution percentage.

  • If the percentage is 100%, the plan will reflect 100%.

  • If the percentage is less than 100%, the plan will reflect "At least" followed by the total unsecured pot amount.


§ IV.E – Specially Classified Nonpriority Unsecured Claims List any unsecured claims with special treatment that should be paid before other nonpriority unsecured claims. For each claim, enter the claim priority rank, creditor name, claim balance, percentage to be paid, and reason for special classification.


§ V.A – Direct Payment — Domestic Support Obligations List any domestic support obligation claims where the treatment is to pay outside the plan. For each claim, enter the creditor name and monthly payment amount.


§ V.B – Other Direct Payments List all claims that are not domestic support obligation claims where the treatment is to pay outside the plan. For each claim, enter the creditor name, nature of the debt (claim type or consideration), and monthly payment amount.


§ VI – Surrendered Property List all claims where the intent is to surrender. For each claim, enter the creditor name and a description of the property to be surrendered.


§ VII – Executory Contracts and Leases List all lease claims. For each entry, enter the creditor name and indicate whether the intent is to assume or reject.
