When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.2.1 – Mortgage Claims — Conduit List all mortgage claims where the treatment is to pay conduit and the intent is not to surrender or avoid. Do not list mortgage arrearage claims here. For each claim, enter the creditor name, description of the property, monthly payment amount, and the month and year the payment commences (the month after the current month).
§ 3.2.2 – Mortgage Arrearages List all mortgage arrearage claims where the intent is not to surrender or avoid. For each claim, enter the creditor name, description of the property, arrearage balance, interest rate, and monthly payment amount.
§ 3.2.3 – Secured Claims Paid Within Plan Term List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, description of the property, total claim amount from Schedule D, secured claim balance, interest rate, monthly payment, and the month and year the payment commences.
§ 3.2.4 – 910 Claims List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, description of the property, total claim amount, secured claim balance, interest rate, monthly payment, and the month and year the payment commences.
§ 3.3 – Secured Claims Paid Directly by Debtor List all real property secured claims where the treatment is to pay outside the plan. For each claim, enter the creditor name, property address and parcel number, total claim balance, property value, interest rate, monthly payment, and the date of the final payment.
§ 3.4 – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name, collateral description, and collateral value.
§ 3.5 – Lien Avoidance List all claims where the intent is to avoid the lien. For each claim, enter the creditor name, value and description of the property, and the exemption that is impaired.
§ 4.2.1 – Domestic Support Obligations Paid Directly by Debtor List all domestic support obligation claims where the treatment is to pay outside the plan. For each claim, enter the creditor name and total monthly payment amount.
§ 4.2.2 – Domestic Support Obligations Paid by Trustee List all domestic support obligation claims where the treatment is to pay inside the plan. For each claim, enter the creditor name, total monthly payment amount, and the month and year the payment commences.
§ 4.3 – Other Priority Claims List all priority claims that are not domestic support obligation claims and not tax claims. For each claim, enter the creditor name, description or type of claim, and claim balance.
§ 4.4.1 – Pre-Petition Tax Returns List all priority claims where the claim type is Taxes and Other Government Units. For each claim, enter the tax agency name, type of tax obligation, tax periods owed, and the date the return will be filed.
§ 5.1 – Separately Classified Nonpriority Unsecured Claims List all unsecured claims that have special treatment. For each claim, enter the creditor name, description or type of claim, and claim balance.
§ 6.1 – Assumed Executory Contracts and Leases List all lease claims where the intent is to assume. Do not list lease arrearage claims here. For each entry, enter the creditor name, type of agreement, description of the property, monthly payment amount, and the month and year the payment commences.
§ 6.2 – Cure of Lease Arrearages List all lease arrearage claims where the intent is to assume the underlying lease. For each claim, enter the creditor name, arrearage balance, interest rate, and monthly payment amount.
§ 6.3 – Rejected Executory Contracts and Leases List all lease claims where the intent is to reject. For each entry, enter the creditor name, type of agreement, description of the property, and monthly payment amount.
