Chapter 13: Virginia Eastern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.B – Priority Claims (Non-DSO) List all priority claims that are not domestic support obligation claims. For each claim, enter the creditor name, type of priority, estimated claim balance, monthly payment amount, and number of months (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number).


§ 3.C – Domestic Support Obligations List all domestic support obligation claims. For each claim, enter the creditor name, type of priority, estimated claim balance, monthly payment amount, and number of months (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number).


§ 4.A – Motions to Value Collateral — Cramdown List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, collateral description, date the debt was incurred, estimated debt balance from Schedule D, and the replacement value (secured balance from the Chapter 13 calculator). The interest rate, monthly payment, and term will be populated in § 4.D.


§ 4.B – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name, collateral description, estimated value, and estimated total claim balance.


§ 4.D – Payment of Secured Claims — Property Being Retained List all secured claims that are not attached to the debtor's residential property and where the intent is not to surrender or avoid and where the treatment is not to pay outside the plan. For each claim, enter the creditor name, collateral description, approximate debt balance or crammed-down value, interest rate, monthly payment amount, and number of months (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number).


§ 5.B – Separately Classified Unsecured Claims List all unsecured claims with special treatment. For each claim, enter the creditor name, basis for classification, and treatment description.


§ 6.A – Mortgage — Debtor Makes Payments Directly List all secured claims attached to the debtor's residential property where the intent is not to surrender or avoid and the treatment is to pay outside the plan. Also include any unsecured claims with the treatment long-term — maintain payments outside the plan and cure arrearages inside the plan. Do not list mortgage arrears as a separate claim. For each claim, enter the creditor name, collateral description, regular contract payment amount, estimated arrearage balance (if any), interest rate on the arrearage (if any), estimated cure period in months, and monthly arrearage payment.


§ 6.B – Mortgage — Trustee Makes Payments List all secured claims attached to the debtor's residential property where the intent is not to surrender or avoid and the treatment is not to pay outside the plan. Also include any unsecured claims with the treatment long-term — maintain payments and cure arrearages inside the plan. Do not list mortgage arrears as a separate claim. For each claim, enter the creditor name, collateral description, regular contract payment amount, estimated arrearage balance (if any), interest rate on the arrearage (if any), monthly arrearage payment, and number of months to cure (calculated by dividing the arrearage balance by the monthly payment, rounded up to the nearest whole number).


§ 6.C – Mortgage — Restructured, Paid in Full During Plan List all secured claims attached to the debtor's residential property where the treatment is to pay the mortgage in full through the plan. For each claim, enter the creditor name, collateral description, interest rate, estimated claim balance, monthly payment amount, and number of months (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number).


§ 7.A – Executory Contracts and Leases — Rejected List all leases where the intent is to reject. For each entry, enter the creditor name and type of contract.


§ 7.B – Executory Contracts and Leases — Assumed List all leases where the intent is to assume. For each entry, enter the creditor name, type of contract, arrearage balance (if any), monthly arrearage payment, and estimated cure period in months (calculated by dividing the arrearage balance by the monthly payment, rounded up to the nearest whole number).


§ 8.A – Lien Avoidance Under § 522(f) List all secured claims where the intent is to avoid the lien. For each claim, enter the creditor name, collateral description, exemption basis, exemption amount saved on the asset, and collateral value (fair market value).
