Chapter 13: Texas Southern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.B – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § 8(B), § 9(B), § 12, or § 13.

  • If you have added claims under any of those sections, the plan will reflect that this provision is Included.

  • If you have no such claims, the plan will reflect that this provision is Not Included.


§ 1.C/D – Lien Avoidance This section is controlled by whether you have added any claims under § 8(E) or § 13.

  • If you have added claims under § 8(E) or § 13, the plan will reflect that this provision is Included.

  • If you have no such claims, the plan will reflect that this provision is Not Included.


§ 5 – Domestic Support Obligations List all domestic support obligation claims. For each claim, enter the creditor name, claim amount, interest rate, monthly payment amount, and the first and last payment month numbers.


§ 6 – Priority Claims (Non-DSO) List all priority claims that are not domestic support obligation claims. Include attorney fees as the first entry if any fees are owed; for attorney fees, the payment will be listed as pro-rata. For each additional claim, enter the creditor name, claim amount, interest rate, monthly payment amount, and the first and last payment month numbers.


§ 7 – Surrender of Collateral List any secured claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral.


§ 8(A) – Principal Residence Mortgage List any mortgage claims attached to the debtor's residential property where the intent is not to surrender or avoid and the treatment is to pay conduit or pay in full through the plan. Enter the property address at the top of the section. For each claim, enter the creditor name and collateral description.

If there is an arrearage, enter the arrearage balance, interest rate, and payment information in the Cure Claim row.

If the treatment is to pay conduit, enter the monthly payment in the Monthly Mortgage Payment row and leave the Total Debt Claim row blank.

If the treatment is to pay in full through the plan, enter the total balance and payment information in the Total Debt Claim row and leave the Monthly Mortgage Payment row blank.

If there are no such claims, the section will show "None."


§ 8(B) – Other Real Property Mortgage List any mortgage claims not attached to the debtor's residential property where the intent is not to surrender or avoid and the treatment is to pay conduit or pay in full through the plan. Enter the property address at the top of the section. For each claim, enter the creditor name, collateral description, and collateral value. Enter arrearage, monthly payment, or total debt claim information in the appropriate rows based on the treatment selected. If there are no such claims, the section will show "None."


§ 8(C) – Non-Residential Mortgage — Direct Pay List any mortgage claims not attached to the debtor's residential property with no arrearages where the intent is not to surrender or avoid and the treatment is to pay outside the plan. Enter the property address at the top of the section. For each claim, enter the creditor name, total claim balance, collateral description, collateral value, contract interest rate, monthly payment, and date of the last payment. If there are no such claims, the section will show "None."


§ 8(E) – Lien Stripping — Real Property List any mortgage claims where the intent is to avoid the lien by demonstrating that senior liens exceed the property value. Enter the property address at the top of the section. For each claim, enter the creditor name and address, the debtor's stated property value, and the name and balance owed to each lienholder that is senior in priority. If there are no such claims, the section will show no checkbox checked.


§ 9(A) – 910 Claims — Personal Property List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, and collateral value. If there is an arrearage, enter the arrearage balance, interest rate, and monthly payment in the Cure Claim and Monthly Payment rows. If there is no arrearage, enter the full claim balance, interest rate, and monthly payment in the Total Debt Claim row. If there are no such claims, this section will indicate "None."


§ 9(B) – Other Secured Claims — Personal Property List any secured claims not already covered in § 8(A), § 8(B), § 8(C), § 8(E), § 9(A), or § 9(C). For each claim, enter the creditor name, claim amount, collateral description, collateral value, and interest rate. Enter arrearage, monthly payment, or total debt claim information in the appropriate rows based on the treatment selected. If there are no such claims, the section will indicate "None."


§ 9(C) – Secured Claims Paid Directly by Debtor List any secured claims where the intent is to pay outside the plan. For each claim, enter the creditor name, claim balance, collateral description, collateral value, contract interest rate, monthly payment, and date the last payment is due. If there are no such claims, this section will indicate "None."


§ 13 – Lien Avoidance Under § 522(f) List any secured claims that are not attached to the debtor's residential property where the intent is to avoid the lien. For each claim, enter the collateral description, creditor name and address, property value, total amount of all secured claims senior in priority, and total exemption amount claimed on the property. The remaining value subject to the lien will be calculated from these figures.


§ 14 – Specially Classified Unsecured Claims List any unsecured claims that have special treatment. For each claim, enter the creditor name and a description of the treatment and reason for special classification.


§ 16 – Executory Contracts List any lease claims where the intent is not to avoid. For each entry, enter the counterparty name, arrearage balance (enter $0.00 if none), and the equal monthly installment amount for curing the arrearage directly by the debtor.
