Chapter 13: Texas Western District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 6.1 – Assumed Executory Contracts and Leases List all leases where the intent is to assume. Do not list lease arrears here. For each entry, enter the creditor name, property or contract description, and current monthly payment to be paid directly by the debtor.


§ 6.2 – Rejected Executory Contracts and Leases List all leases where the intent is to reject. Do not list lease arrears here. For each entry, enter the creditor name and property description.


§ 7.1 – Attorney Fees Enter the attorney's name, the amount of attorney fees to be paid through the plan, and indicate the payment method (Standing Order or Other).


§ 7.2 – Priority Claims List all priority claims where the treatment is to pay inside the plan, including domestic support obligation claims. For each claim, enter the creditor name, description of the priority type, estimated claim amount, and estimated monthly payment.


§ 7.3 – Arrears on Assumed Executory Contracts and Leases List all assumed lease arrearage claims. For each entry, enter the creditor name and collateral description together, the arrearage balance and treatment of the arrearage through the plan, and the ongoing monthly payment amount.


§ 7.4 – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name, collateral description, and location of the collateral.


§ 7.5 – Creditors Paid Directly by Debtor List all secured claims where the treatment is to pay outside the plan. Do not include mortgage claims here. For each claim, enter the creditor name, collateral description, balance owed, monthly payment, remarks (if any), and identify the payer (debtor, third party, or co-debtor).


§ 7.6 – Mortgage — Ongoing Payments on Principal Residence List all mortgage claims attached to the debtor's residential property where the intent is not to surrender or avoid. For each claim, enter the creditor name, property address, monthly mortgage payment, interest rate (for informational purposes), payment due date per the contract, and indicate whether the payment will be made by the trustee (conduit) or directly by the debtor.


§ 7.7 – Mortgage and Long-Term Debt Arrears List all mortgage arrearage claims and vehicle arrearage claims. For each claim, enter the creditor name, collateral description, estimated arrearage balance, monthly payment or method of distribution, interest rate (if applicable), and any remarks.


§ 7.8 – Secured Claims — § 506 and 910 Day Claims List all claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) or Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, estimated debt amount, fair market value of the collateral, interest rate, equal monthly payment amount, unsecured balance (if any), and indicate whether the claim qualifies as a 910 claim.


§ 7.9 – Wholly Unsecured Real Property Liens List all claims attached to real property where the secured balance has been overridden to $0.00. For each claim, enter the creditor name, collateral description, fair market value of the property, and the total amount owed on all liens senior in priority to this creditor's claim.


§ 7.10 – Lien Avoidance Under § 522(f) List all claims where the intent is to avoid the lien. For each claim, enter the creditor name, description of the property subject to the lien, lien amount to be avoided, secured amount remaining after avoidance (if any), and the type of lien (such as judicial lien or non-possessory, non-purchase money security interest).
