Chapter 13: Texas Northern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

Disclosures – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § I.E(1).

  • If you have added claims under § I.E(1), the plan will reflect that it does limit the amount of a secured claim based on a valuation of the collateral.

  • If you have no claims under § I.E(1), the plan will reflect that it does not limit the amount of a secured claim.


§ I.B.3 – Domestic Support Obligations List any domestic support obligation claims. For each claim, enter the creditor name, scheduled amount, interest rate, term in months, and treatment (monthly payment amount and claim treatment description).


§ I.D(1) – Pre-Petition Mortgage Arrearage List any secured real estate arrearage claims where the intent is not to surrender. For each claim, enter the mortgagee name, collateral description, arrearage balance, date through which the arrearage is calculated, interest rate, term in months, and treatment (monthly payment or pro-rata if no monthly payment was entered).


§ I.D(2) – Current Post-Petition Mortgage Payments — Conduit List any secured mortgage claims where the intent is not to surrender or avoid and the treatment is to pay conduit. For each claim, enter the mortgagee name, collateral description, number of payments to be paid by the trustee (plan length minus any gap payments), current post-petition mortgage payment amount, and first conduit payment due date.


§ I.E(1)(A) – Secured Claims Subject to § 506 — Fixed Monthly Payment List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) and the monthly payment has been set in the calculator. For each claim, enter the creditor name, collateral description, scheduled amount from Schedule D, collateral value, interest rate, term in months, and monthly payment amount with claim treatment.


§ I.E(1)(B) – Secured Claims Subject to § 506 — Pro Rata List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) and the monthly payment has not been set in the calculator. For each claim, enter the creditor name, collateral description, scheduled amount from Schedule D, collateral value, and interest rate. These claims will be paid pro rata.


§ I.E(2)(A) – 910 Claims — Fixed Monthly Payment List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle) and the monthly payment has been set in the calculator. For each claim, enter the creditor name, collateral description, scheduled amount from Schedule D, interest rate, term in months, and monthly payment amount with claim treatment.


§ I.E(2)(B) – 910 Claims — Pro Rata List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle) and the monthly payment has not been set in the calculator. For each claim, enter the creditor name, collateral description, scheduled amount from Schedule D, collateral value, and interest rate. These claims will be paid pro rata.


§ I.F – Surrender of Collateral List any secured claims where the intent is to surrender. For each claim, enter the creditor name, collateral description, scheduled amount, collateral value, and treatment (pro rata).


§ I.G – Secured Claims Paid Directly by Debtor List any secured claims where the treatment is to pay outside the plan. For each claim, enter the creditor name, collateral description, and scheduled amount.


§ I.H – Priority Claims (Non-DSO) List any priority claims that are not domestic support obligation claims. For each claim, enter the creditor name, scheduled amount, term in months, and treatment (monthly payment if overridden, or pro rata if not).


§ I.I – Special Class Unsecured Claims List any unsecured claims with special treatment. For each claim, enter the creditor name, scheduled amount, term in months, and treatment description.


§ I.J – General Unsecured Claims List all unsecured claims where there is no special treatment, in alphabetical order. For each claim, enter the creditor name, scheduled amount, and a comment if applicable. If the claim is the result of a secured claim being overridden, note it as the unsecured portion of a bifurcated secured debt.


§ I.K – Executory Contracts and Unexpired Leases List all leases. For each entry, enter the counterparty name, whether the intent is to assume or reject, cure amount (arrearage balance, if any), term remaining, and treatment.
