When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.1 – Post-Petition Home Mortgage Payments This section is controlled by the mortgage treatment selected for any claim attached to the debtor's principal residence.
If there is no home mortgage, the plan will reflect No Home Mortgage.
If there is a mortgage where the treatment is to pay in full through the plan, the plan will reflect Home Mortgage Maturing Before or During Plan Term, and the claim will be addressed in § 3.2.
If there is a mortgage where the treatment is to pay outside the plan, the plan will reflect Direct Home Mortgage Payments by Debtor Required. Enter the mortgage lienholder name, property address, monthly payment amount, and due date. Indicate whether the monthly payment includes a tax escrow, insurance escrow, or other amounts.
§ 3.2 – Curing Defaults and Maintenance of Direct Payment Obligations List any mortgage or lease arrearages where the treatment is to pay inside the plan. For each claim, enter the creditor name and the appropriate checkbox based on the claim type:
Check Debt Maturing During Plan Term if the arrearage is part of a mortgage being paid in full through the plan.
Check Debt Maturing After Completion of Plan Term if the arrearage is part of a mortgage being paid outside the plan.
Check Curing Assumed Executory Contract or Lease Obligation if the arrearage is part of a lease.
Also enter the collateral or property description, the debtor's direct payment obligation amount (monthly payment on the non-arrearage portion, if that claim is paid outside the plan), projected cure claim amount, plan interest rate, projected monthly payment by the trustee, and projected total cure payment by the trustee. If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims Protected from § 506 Bifurcation (910 Vehicle) List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, adequate protection payment amount and months, 910 claim amount, plan interest rate, equal monthly payment by the trustee, and projected total payment by the trustee. If there are no such claims, this section will indicate "None."
§ 3.4 – Secured Claims Subject to § 506 Bifurcation List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, collateral description, adequate protection payment amount and months, total claim amount from Schedule D, collateral value (fair market value), plan interest rate, equal monthly payment by the trustee, and projected total payment by the trustee. If there are no such claims, this section will indicate "None."
§ 3.5 – Direct Payment of Secured Claims Not in Default List any secured claims where the treatment is to pay outside the plan and where the claim has no arrearage amount. For each claim, enter the creditor name, collateral description, total claim amount as of the petition date, collateral value as of the petition date, contract interest rate, monthly payment per contract, indicate whether the payment will be made by the debtor, co-debtor, or third party, and the date of the final monthly payment. Also provide a justification for the direct payment treatment. If there are no such claims, this section will indicate "None."
§ 3.6 – Surrender of Property List any secured claims where the intent is to surrender. For each claim, enter the creditor name, collateral description, and collateral location. If there are no such claims, this section will indicate "None."
§ 3.9 – Lien Avoidance List any secured claims where the intent is to avoid the lien. Indicate whether the lien is a judicial lien or a non-possessory, non-purchase money security interest, and provide the lien identification details. For each claim enter the following calculated values: (a) amount of the lien, (b) total of all other liens on the same property, (c) total value of claimed exemptions, (d) total of a + b + c, (e) value of the debtor's interest in the property, and (f) the result of subtracting e from d. If the extent of impairment (f) equals or exceeds the lien amount (a), the entire lien is avoided. If f is less than a, enter the remaining secured claim amount, plan interest rate, equal monthly payment by the trustee, payment start and end months, and projected total payments. If there are no such claims, this section will indicate "None."
§ 3.10 – Rule 3012 Valuation of Collateral List any secured claims where the treatment selected is Rule 3012 Valuation of Collateral. For each claim, enter the creditor name, collateral description, and the debtor's asserted collateral value. Also reference the row number in § 3.4 where the same claim appears. If there are no such claims, this section will indicate "None."
§ 3.11 – Lien Removal Based Upon Unsecured Status List any secured claims where the secured balance has been overridden to $0.00. For each claim, enter the creditor name, property address, and debtor's asserted collateral value. Below each claim, list any senior lienholders on the same property with the corresponding balance owed to each. If there are no such claims, this section will indicate "None."
§ 4.4 – Priority Claims — Domestic Support Obligations List any domestic support obligation claims where the balance has not been overridden. For each claim, enter the creditor name, projected DSO claim amount, and projected monthly payment by the trustee. If there are no such claims, this section will indicate "None."
§ 4.5 – Priority Claims — DSO Assigned to Governmental Unit List any domestic support obligation claims where the balance has been overridden and the claim is assigned to or owed to a governmental unit to be paid less than the full amount. For each claim, enter the governmental unit name, projected DSO claim amount, and projected monthly payment by the trustee. If there are no such claims, this section will indicate "None."
§ 4.6 – Priority Claims — Taxes and Other Priority Claims List any priority claims that are not domestic support obligation claims. For each claim, enter the creditor name, projected claim amount, and projected monthly payment by the trustee. Also indicate if the claim is a Texas ad valorem tax claim entitled to 12% annual interest and secured claim disbursement priority. If there are no such claims, this section will indicate "None."
§ 5.1 – Specially Classed Unsecured Claims List any unsecured claims that have special treatment saved to the claim. For each claim, enter the creditor name, projected claim amount, and the reason for special classification and proposed treatment. If there are no such claims, this section will indicate "None."
§ 6.1 – Executory Contracts and Unexpired Leases List any leases where the intent is to assume. Do not list lease arrears as a separate claim. For each entry, enter the counterparty name and a description of the assumed executory contract or lease along with the required monthly payment amount. If there are no such claims, this section will indicate "None."
