Chapter 13: Tennessee Eastern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1 – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § 3.2.

  • If you have added claims under § 3.2, the plan will reflect Yes.

  • If you have no claims under § 3.2, the plan will reflect No.


§ 1.2 – Lien Avoidance This section is controlled by whether you have added any claims under § 3.4.

  • If you have added claims under § 3.4, the plan will reflect Yes.

  • If you have no claims under § 3.4, the plan will reflect No.


§ 3.1 – Maintenance of Payments and Cure of Default List all secured mortgage claims where the intent is not to surrender or avoid and the treatment is to pay conduit or outside the plan. Do not list arrears as separate claims. For each claim, enter the creditor name, collateral description, whether the property is the debtor's principal residence (Yes or No), installment payment amount, whether the payment is made directly by the debtor (Yes if paying outside the plan, No if paying conduit), arrearage amount (if any), interest rate on the arrearage (if any), and arrearage monthly payment.


§ 3.2 – Valuation and Modification of Secured Claims List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, collateral description, secured amount, interest rate, monthly payment, and whether the payment is made directly by the debtor (Yes if paying outside the plan, No if paying inside the plan).


§ 3.3 – Secured Claims Excluded from § 506 List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, amount of the claim, interest rate, monthly payment, and whether the payment is made directly by the debtor (Yes if paying outside the plan, No if paying inside the plan).


§ 3.4 – Lien Avoidance List all secured claims where the intent is to avoid the lien. For each claim, enter the creditor name and the following calculated values: (A) amount of the lien, (B) total of all other liens on the same property, (C) total exemption amount on the property, (D) fair market value of the property, (E) extent of impairment (calculated as A + B + C minus D), and (F) secured claim remaining after avoidance (calculated as A minus E — enter $0.00 if negative). Also enter the interest rate and monthly payment on any remaining secured claim.


§ 3.5 – Surrender of Collateral List all secured claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral.


§ 3.6 – Secured Claims Paid by Third Party List all claims where the treatment is to pay outside the plan by a co-debtor. For each claim, enter the creditor name, collateral description, and the name of the co-debtor who will make the payment.


§ 6.1 – Executory Contracts and Unexpired Leases List all lease claims where the intent is to assume. Do not list lease arrears as a separate claim. For each entry, enter the creditor name, description of the contract or lease, installment payment amount, whether the payment is made directly by the debtor (Yes if paying outside the plan, No if paying inside the plan), arrearage amount (if any), and arrearage monthly payment.
