When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.2 – Valuation and Modification of Secured Claims List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, estimated total claim amount from Schedule D, collateral description, value of the collateral, amount of all claims senior to this creditor's claim, secured claim amount, interest rate, monthly payment, and estimated total of monthly payments (amortized balance). If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims Excluded from § 506 List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, amount of the claim, interest rate, and monthly payment. Indicate whether the payment will be disbursed by the trustee or directly by the debtor. If there are no such claims, this section will indicate "None."
§ 3.4 – Lien Avoidance List any secured claims where the intent is to avoid the lien. For each claim, enter the creditor name, collateral description, lien identification details (such as judgment date, recording date, and book and page number), amount of the lien, amount of all other liens on the same property, value of claimed exemptions, and the value of the debtor's interest in the property. The extent to which the lien is avoided will be calculated from these values. Also enter the secured claim amount remaining after avoidance (if any), interest rate, monthly payment, and estimated total payments on the secured claim. If there are no such claims, this section will indicate "None."
§ 3.7 – Other Secured Claim Modifications List any secured claims where the option is selected for modification pursuant to 11 U.S.C. § 1322(b)(2) and/or § 1322(c)(2). For each claim, enter the creditor name, claim ID number, claim amount, modified interest rate, modified term in months, modified principal and interest payment, property tax escrow amount (if any), property insurance escrow amount (if any), total monthly payment, and estimated total payments by the trustee. If there are no such claims, this section will indicate "None."
§ 4.4 – Priority Claims List all priority claims other than attorney's fees and domestic support obligations. For each claim, enter the creditor name and estimated amount of the claim to be paid. If there are no such claims, this section will indicate "None."
§ 5.2 – Maintenance of Payments on Nonpriority Unsecured Claims List any unsecured claims where the treatment is any of the three long-term treatment types. For each claim, enter the creditor name, current installment payment amount, arrearage balance to be paid (if any), and estimated total payments by the trustee. Indicate whether the payment will be disbursed by the trustee or directly by the debtor.
If the treatment is long-term — maintain payments inside the plan, or long-term — maintain payments and cure arrearages inside the plan, mark Trustee.
If the treatment is long-term — maintain payments outside the plan and cure arrearages inside the plan, mark Debtor.
If there are no such claims, this section will indicate "None."
§ 5.3 – Other Separately Classified Nonpriority Unsecured Claims List all unsecured nonpriority claims that have special treatment saved to the claim. For each claim, enter the creditor name, basis for separate classification and treatment, treatment type, total amount to be paid on the claim, interest rate (if applicable), number of months, starting plan month, monthly payment amount, and estimated total amount of payments. If there are no such claims, this section will indicate "None."
§ 6.1 – Executory Contracts and Unexpired Leases List all leases where the intent is to assume. Do not list lease arrears as a separate claim. For each entry, enter the creditor name, description of the leased property or executory contract, current installment payment amount, indicate whether the payment will be disbursed by the trustee or directly by the debtor, arrearage amount to be paid (if any), treatment of the arrearage, and estimated total payments by the trustee. If there are no such claims, this section will indicate "None."
