Chapter 13: Pennsylvania Middle District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

Notice 2 – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § 2.E.

  • If you have added claims under § 2.E, the plan will reflect that this provision is Included.

  • If you have no claims under § 2.E, the plan will reflect that this provision is Not Included.


Notice 3 – Lien Avoidance This section is controlled by whether you have added any claims under § 2.G.

  • If you have added claims under § 2.G, the plan will reflect that this provision is Included.

  • If you have no claims under § 2.G, the plan will reflect that this provision is Not Included.


§ 1.A.4 – Median Income Determination This section is controlled by the debtor's income relative to the state median.

  • If the debtor is at or under median income, the plan will reflect that the debtor is at or under median income and the rest of this section will not be completed.

  • If the debtor is over median income, the plan will reflect that the debtor is over median income and will include the estimated minimum amount that must be paid to allowed unsecured creditors to comply with the Means Test.


§ 2.B – Mortgages and Direct Payments by Debtor List any secured claims where the treatment is to pay outside the plan or pay outside the plan by a co-debtor. For each claim, enter the creditor name, description of the collateral, and last four digits of the account number. If there are no such claims, this section will indicate "None."


§ 2.C – Arrears List any secured arrearage claims where the treatment is to pay inside the plan. For each claim, enter the creditor name, description of the collateral, estimated pre-petition arrears to be cured, estimated post-petition arrears to be cured (if any), and estimated total to be paid in the plan. If there are no such claims, this section will indicate "None."


§ 2.D – Other Secured Claims — § 506 Not Applicable List any secured claims where the 910 treatment is selected, any mortgage claims where the treatment is to pay conduit, and any secured claims where the treatment is to pay inside the plan and neither the 910 nor cramdown treatment options have been selected. For each claim, enter the creditor name, description of the collateral, principal balance of the claim, interest rate, and total to be paid in the plan. For mortgage claims, the total reflects the monthly payment multiplied by the plan length. For all other secured claims, the total reflects the amortized balance. If there are no such claims, this section will indicate "None."


§ 2.E – Secured Claims — § 506 Valuation Applicable List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, description of the collateral, value of the collateral (modified principal), interest rate, total payment, and indicate whether the lien will be addressed through the plan, an adversary proceeding, or other action. If there are no such claims, this section will indicate "None."


§ 2.F – Surrender of Collateral List any claims where the intent is to surrender. For each claim, enter the creditor name and description of the collateral to be surrendered. If there are no such claims, this section will indicate "None."


§ 2.G – Lien Avoidance List any claims that are not mortgages and where the intent is to avoid the lien. For each claim, enter the creditor name, lien description (including court and docket number for judicial liens), description of the liened property, liened asset value, sum of all senior liens on the same property, exemption amount claimed, and amount of the lien to be avoided. If there are no such claims, this section will indicate "None."


§ 3.B – Priority Claims List all priority claims. For each claim, enter the creditor name and estimated total payment.


§ 4.A – Specially Classified Unsecured Claims List any unsecured claims with special treatment. For each claim, enter the creditor name, reason for special classification, estimated claim amount, interest rate, and estimated total payment through the plan. If there are no such claims, this section will indicate "None."


§ 5 – Executory Contracts and Unexpired Leases List any lease claims. Do not list lease arrears as separate claims. For each entry, enter the creditor name, description of the contract or lease, monthly payment, interest rate, estimated arrears (if any), total plan payment, and whether the intent is to assume or reject. If there are no such claims, this section will indicate "None."
