When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 2.3 – Means Test Determination This section is controlled by the debtor's income relative to the state median.
If the debtor is below median income, the plan will reflect that the projected plan length must be a minimum of 36 months but not exceed 60 months.
If the debtor is above median income, the plan will reflect that the projected plan length must be 60 months.
§ 5.1.1 – Maintenance of Regular Mortgage Payments — Trustee Disburse List any mortgage claims where the intent is not to surrender or avoid and the treatment is to pay conduit. For each claim, enter the creditor name, property address, whether the property is the debtor's residence (Y or N), and the monthly payment amount. If there are no such claims, this section will indicate "None."
§ 5.1.1 – Maintenance of Regular Mortgage Payments — Debtor Direct Pay List any mortgage claims where the intent is not to surrender or avoid and the treatment is to pay outside the plan. For each claim, enter the creditor name, property address, whether the property is the debtor's residence (Y or N), and the monthly payment amount. If there are no such claims, this section will indicate "None."
§ 5.1.2(A) – Cramdown — Real Property List any secured mortgage claims where the intent is not to surrender or avoid, the treatment is to pay the mortgage in full through the plan, and the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, property address, property value, name and amount of any senior mortgages or liens, interest rate, and minimum monthly payment. Also indicate the procedure to be used (Motion, Plan, or Claim Objection). If there are no such claims, this section will indicate "None."
§ 5.1.2(B) – Non-Cramdown — Real Property List any secured mortgage claims where the intent is not to surrender or avoid, the treatment is to pay the mortgage in full through the plan, and the treatment is not Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, property description, estimated claim amount, interest rate, and minimum monthly payment including interest. If there are no such claims, this section will indicate "None."
§ 5.1.3 – Claims Secured by Personal Property — 910 Claims List any secured claims attached to personal property where the intent is not to surrender or avoid, the treatment is to pay inside the plan, and the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, property description, purchase date, estimated claim amount, interest rate, and minimum monthly payment including interest. If there are no such claims, this section will indicate "None."
§ 5.1.4(A) – Cramdown — Personal Property List any secured claims attached to personal property where the intent is not to surrender or avoid, the treatment is to pay inside the plan, and the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, property description, purchase or transaction date, property value, estimated secured claim amount, interest rate, and minimum monthly payment including interest. Also indicate the procedure to be used (Motion, Plan, or Claim Objection). If there are no such claims, this section will indicate "None."
§ 5.1.4(B) – Non-Cramdown — Personal Property List any secured claims attached to personal property where the intent is not to surrender or avoid, the treatment is to pay inside the plan, and neither the 910 nor cramdown box is selected. For each claim, enter the creditor name, property description, estimated secured claim amount, interest rate, and minimum monthly payment including interest. If there are no such claims, this section will indicate "None."
§ 5.1.6 – Rejected Executory Contracts and Unexpired Leases List any leases where the intent is to reject. For each entry, enter the creditor name and property description. If there are no such claims, this section will indicate "None."
§ 5.1.6 – Assumed Leases — Trustee Disburse List any leases where the intent is to assume and the treatment is to pay inside the plan. Do not list arrears as a separate claim. For each entry, enter the creditor name, property description, regular number of payments remaining as of the petition date (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number), monthly contract or lease payment, estimated arrearage as of the petition date (if any), and contract or lease termination date. If there are no such claims, this section will indicate "None."
§ 5.1.6 – Assumed Leases — Debtor Direct Pay List any leases where the intent is to assume and the treatment is to pay outside the plan. Do not list arrears as a separate claim. For each entry, enter the creditor name, property description, regular number of payments remaining as of the petition date (calculated by dividing the balance by the monthly payment, rounded up to the nearest whole number), monthly contract or lease payment, estimated arrearage as of the petition date (if any), and contract or lease termination date. If there are no such claims, this section will indicate "None."
§ 5.2.1 – Secured Claims with No Designated Monthly Payments List any secured claims that are not mortgages (but include mortgage arrearages), where the intent is not to avoid or surrender, the treatment is to pay inside the plan, and neither the cramdown nor 910 box is selected. For each claim, enter the creditor name, description of the claim or collateral, estimated claim amount, and interest rate. If there are no such claims, this section will indicate "None."
§ 5.2.2 – Domestic Support Obligations — Arrearages List any domestic support obligation arrearage claims. For each claim, enter the creditor name, state child support enforcement agency (if any), estimated arrearage amount, and indicate whether the claim will be paid by the debtor or the trustee. If there are no such claims, this section will indicate "None."
§ 5.4.1 – Wholly Unsecured Mortgages/Liens List any mortgage claims where the treatment is to pay in full through the plan and the secured balance has been overridden to $0.00. For each claim, enter the creditor name, property address, property value, total balance of all senior liens on the same property, and the unsecured balance of the claim. If there are no such claims, this section will indicate "None."
§ 5.4.4 – Mortgages to be Avoided Under § 544 List any mortgage claims where the intent is to avoid. For each claim, enter the creditor name, indicate whether the action will be filed by the debtor or the trustee, and the property address. If there are no such claims, this section will indicate "None."
§ 5.5(A) – Claims Paid by Non-Filing Co-Debtor List any claims where the treatment is to pay outside the plan by a co-debtor. For each claim, enter the creditor name, name of the co-debtor making the payment, and description of the claim or collateral. If there are no such claims, this section will indicate "None."
§ 5.5(B) – Claims Paid by Debtor or Trustee with Co-Debtor List any claims with a co-debtor that is not the joint debtor and where the treatment is to pay inside the plan. For each claim, enter the creditor name, description of the claim or collateral, amount of the claim, monthly payment amount, interest rate, and indicate whether the payment will be made by the debtor or the trustee. If there are no such claims, this section will indicate "None."
§ 5.6 – Claims Paid Directly by the Debtor List any claims where the treatment is to pay outside the plan. For each claim, enter the creditor name, description of the claim or collateral, and monthly payment amount. If there are no such claims, this section will indicate "None."
§ 6 – Surrender of Property List any claims where the intent is to surrender. For each claim, enter the creditor name and a description of the property. If there are no such claims, this section will indicate "None."
