Chapter 13: North Carolina Eastern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1 – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § 3.3.

  • If you have added claims under § 3.3, the plan will reflect that this provision is Included.

  • If you have no claims under § 3.3, the plan will reflect that this provision is Not Included.


§ 1.2 – Lien Avoidance This section is controlled by whether you have added any claims under § 3.5.

  • If you have added claims under § 3.5, the plan will reflect that this provision is Included.

  • If you have no claims under § 3.5, the plan will reflect that this provision is Not Included.


§ 3.2 – Maintenance of Payments and Cure of Default List all secured mortgage claims where the intent is not to surrender or avoid, and include any secured claims where the treatment is to pay outside the plan. Also include any vehicle claims with arrears — do not include those vehicles separately in § 3.3 or § 3.4. Do not list secured arrearages as separate claims. For each claim, enter the creditor name, collateral description, current installment payment amount (including escrow), arrearage balance (if any), and interest rate on the arrearage (if applicable). Indicate whether the payment will be disbursed by the trustee (conduit) or directly by the debtor. If there are no such claims, this section will indicate "None."


§ 3.3 – Valuation and Modification of Secured Claims List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, estimated total claim amount from Schedule D, collateral description, value of the collateral, amount of all claims senior to this creditor's claim (leave blank if the claim is in first priority position), secured claim amount, and interest rate. If there are no such claims, this section will indicate "None."


§ 3.4 – Claims Excluded from § 506 List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, amount of the claim, interest rate, and the basis for the claim (910 Claim, 1-Year Claim, or Other Claim). If there are no such claims, this section will indicate "None."


§ 3.5 – Avoidance of Judicial Liens List any secured claims where the intent is to avoid the lien. For each claim, enter the creditor name, property subject to the lien, type of lien (Judicial or NPMSI), total claim amount from Schedule D, secured claim amount, and unsecured claim amount (if any). If there are no such claims, this section will indicate "None."


§ 3.6 – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral. If there are no such claims, this section will indicate "None."


§ 4.4 – Domestic Support Obligations List all domestic support obligation claims. For each claim, enter the creditor name, amount of the claim, which debtor owes the obligation (in a joint case), and whether the payment will be made by the trustee or directly by the debtor. If there are no such claims, this section will indicate "None."


§ 4.5 – Priority Claims List all priority claims that are not domestic support obligation claims. For each claim, enter the creditor name, claim type, and estimated claim amount. If there are no such claims, this section will indicate "None."


§ 5.2 – Specially Classified Unsecured Claims List all unsecured claims with special treatment. For each claim, enter the creditor name, basis for separate classification and treatment, amount to be paid on the claim, and interest rate (if applicable). If there are no such claims, this section will indicate "None."


§ 6.1 – Executory Contracts and Unexpired Leases List all lease claims. For each entry, enter the creditor or lessor name, subject of the lease or contract, whether the intent is to assume (A) or reject (R), pre-petition arrearage to be cured (if any), interest rate on the arrearage, term of cure, current monthly payment, and contract or lease end date. If there are no such claims, this section will indicate "None."
