When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.1 – Maintenance of Payments and Cure of Default List all secured mortgage claims where the treatment is to pay conduit. Also include any vehicle claims with arrears — do not include those vehicles separately in § 3.2 or § 3.3. Do not list the secured arrearage as a separate claim. For each claim, enter the creditor name, collateral description, current installment payment amount, arrearage balance (if any), and interest rate on the arrearage (if applicable). Indicate whether the payment will be disbursed by the trustee or directly by the debtor. If there are no such claims, this section will indicate "None."
§ 3.2 – Valuation and Modification of Secured Claims List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, collateral description, value of the collateral, amount of all claims senior to this creditor's claim, secured claim amount (net value), interest rate, equal monthly payment, and pre-confirmation adequate protection payment. If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims Excluded from § 506 List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, collateral description, amount of the claim, interest rate, equal monthly payment, and pre-confirmation adequate protection payment. If there are no such claims, this section will indicate "None."
§ 3.4 – Lien Avoidance List any secured claims where the intent is to avoid the lien. For each claim, enter the creditor name, collateral description or property address, lien identification details (such as judgment date, recording date, and book and page number), amount of the lien, amount of all other liens on the same property, value of claimed exemptions, value of the debtor's interest in the property, and the calculated extent to which the lien is avoided. Also indicate whether the collateral is owned solely or jointly, and the date the collateral was acquired. If there are no such claims, this section will indicate "None."
§ 3.5 – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral. If there are no such claims, this section will indicate "None."
§ 3.6 – Secured Claims to be Paid in Full List all secured mortgage claims where the treatment is to pay in full inside the plan, and all secured non-mortgage claims that do not have cramdown or 910 treatment selected. For each claim, enter the creditor name, collateral description, amount of the claim, and interest rate. If there are no such claims, this section will indicate "None."
§ 4.4 – Priority Claims List all priority claims that are not domestic support obligation claims. For each claim, enter the creditor name, amount of the claim, and basis for priority treatment. If there are no such claims, this section will indicate "None."
§ 5.1 – Disposable Income Calculation This section reflects the disposable income amount from line 45 of Form 122C-2 multiplied by 60 months.
§ 5.2 – Maintenance of Payments on Nonpriority Unsecured Claims List any unsecured claims where the treatment is any of the three long-term treatment types. For each claim, enter the creditor name, current installment payment amount, and arrearage balance (if any). Indicate whether the payment will be disbursed by the trustee or directly by the debtor.
If the treatment is long-term — maintain payments inside the plan, or long-term — maintain payments and cure arrearages inside the plan, mark Trustee.
If the treatment is long-term — maintain payments outside the plan and cure arrearages inside the plan, mark Debtor.
If there are no such claims, this section will indicate "None."
§ 5.3 – Other Separately Classified Nonpriority Unsecured Claims List all unsecured nonpriority claims that have special treatment saved to the claim. For each claim, enter the creditor name, basis for separate classification and treatment, amount of the claim, and percentage of the claim to be paid. If there are no such claims, this section will indicate "None."
§ 6.1 – Executory Contracts and Unexpired Leases List all leases. Do not list lease arrears as a separate claim. For each entry, enter the creditor name, description of the leased property or executory contract, whether the intent is to assume or reject, current installment payment amount, whether the payment will be disbursed by the trustee or directly by the debtor, and arrearage amount to be disbursed by the trustee (if any).
If the treatment is to pay inside the plan, mark Trustee for the current installment payment.
If the treatment is to pay outside the plan, mark Debtor for the current installment payment.
If there are no such claims, this section will indicate "None."
