When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1 – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § 3.2.
If you have added claims under § 3.2, the plan will reflect that this provision is Included.
If you have no claims under § 3.2, the plan will reflect that this provision is Not Included.
§ 1.2 – Lien Avoidance This section is controlled by whether you have added any claims under § 3.4.
If you have added claims under § 3.4, the plan will reflect that this provision is Included.
If you have no claims under § 3.4, the plan will reflect that this provision is Not Included.
§ 2.2 – Debtor Employer Withholding If any income source has the box checked for Use for Chapter 13 Employer Withholding for the debtor, the employer's name and address will be listed here. If no income source has that box checked, this section will be left blank.
§ 2.2 – Joint Debtor Employer Withholding If any income source has the box checked for Use for Chapter 13 Employer Withholding for the joint debtor, the employer's name and address will be listed here. If no income source has that box checked, this section will be left blank.
§ 3.1 – Mortgages This section contains three subsections. If there are no mortgage claims, this section will indicate "None."
If there are mortgage claims attached to the debtor's residential property where the intent is not to surrender, those claims will be listed under § 3.1(a) — Principal Residence Mortgages. For each claim, enter the creditor name, monthly payment amount, and arrearage balance (if any). Indicate whether the payment will be made through the plan or directly by the debtor, and whether the mortgage includes an escrow for taxes or insurance (Yes or No). If there is more than one lien on the property, list the first priority claim first.
If there are mortgage claims attached to property that is not the debtor's residential property where the intent is not to surrender, those claims will be listed under § 3.1(b) — Non-Principal Residence Mortgages. For each property, enter the property address and list each claim with the creditor name, monthly payment amount, and arrearage balance (if any). Indicate whether the payment will be made through the plan or directly by the debtor, and whether the mortgage includes an escrow for taxes or insurance (Yes or No).
If there are mortgage claims where the treatment is to pay the mortgage in full through the plan, those claims will be listed under § 3.1(c) — Mortgage Claims to be Paid in Full. For each claim, enter the creditor name, approximate amount due, interest rate, property address, secured balance, and unsecured balance (if any).
§ 3.2 – Valuation and Modification of Secured Claims List all secured claims where the secured balance is less than the balance on Schedule D, the intent is not to surrender, and the treatment is to pay inside the plan. For each claim, enter the creditor name, estimated total claim amount from Schedule D, collateral description, value of the collateral, amount of the secured claim, and interest rate. If any claims in this section are attached to real estate or mobile homes, also enter the monthly amount for any special taxes or insurance claim. If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims Excluded from § 506 List all secured claims that are not mortgages where the secured balance is the same as the balance on Schedule D, the intent is not to surrender, and the treatment is to pay inside the plan. For each claim, enter the creditor name, collateral description, amount of the claim, and interest rate. If there are no such claims, this section will indicate "None."
§ 3.4 – Motion to Avoid Lien List any claims where the intent is to avoid the lien. For each claim, enter the creditor name, property subject to the lien, lien amount to be avoided, secured amount remaining, type of lien, and lien identification details (such as judgment date, recording date, and book and page number). If there are no such claims, this section will indicate "None."
§ 3.5 – Surrender of Collateral List any claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral. If there are no such claims, this section will indicate "None."
§ 4.4 – Priority Claims List all priority claims that are not domestic support obligation claims. This section is controlled by the type of priority claim entered.
If there are any federal tax claims, the Internal Revenue Service box will be checked and the total balance listed.
If there are any state tax claims, the Mississippi Dept. of Revenue box will be checked and the total balance listed.
If there are any other priority claims, the Other box will be checked with the claim type and total balance listed.
If there are no priority claims, this section will indicate "None."
§ 4.5 – Domestic Support Obligations This section is controlled by whether any domestic support obligation claims have been entered.
If there are domestic support obligation claims, the pre-petition arrearage amount will be listed and the section will reflect that the arrearage is to be paid in full over the plan term.
If there are no domestic support obligation claims, this section will indicate "None."
§ 5.2 – Separately Classified Nonpriority Unsecured Claims List any unsecured claims with special treatment. For each claim, enter the creditor name, basis for separate classification and treatment, approximate amount owed, and proposed treatment. If there are no such claims, this section will indicate "None."
§ 6.1 – Executory Contracts and Unexpired Leases List any lease claims where the intent is to assume. For each entry, enter the creditor name, description of the leased property or executory contract, current installment payment amount, whether the payment will be disbursed by the trustee or directly by the debtor, arrearage amount (if any), and treatment of the arrearage. If there are no such claims, this section will indicate "None."
