Chapter 13: Nebraska District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 5(A) – Domestic Support Obligations List any domestic support obligation claims, excluding those with arrearages. For each claim, enter the creditor name, address, city, state, zip code, and telephone number. The name of the debtor who owes the domestic support obligation will also be noted. If there are no such claims, this section will indicate "None."


§ 5(B) – Domestic Support Obligation Arrearage Claims List any domestic support obligation claims that have arrearages. For each claim, enter the creditor name, estimated arrearage claim amount, and minimum monthly payment on the arrearage. If there are no such claims, this section will indicate "None."


§ 5(D) – Priority Tax Claims List any priority claims where the type is Taxes and Other Government Units and the type of tax obligation is Federal or State. Enter the total amount owed to all federal claims, the total amount owed to all state claims, and the combined total. If there are no such claims, this section will indicate "None."


§ 6(A.1) – Home Mortgage Claims — Conduit List all mortgage claims where the intent is not to avoid or surrender and the treatment is to pay conduit. Do not list mortgage arrearages as separate claims. For each claim, enter the creditor name, collateral, estimated pre-petition arrearage (if any), pre-confirmation interest rate and dollar amount limit (if any), post-confirmation interest rate, minimum monthly payment on pre-petition arrears, and total payments on pre-petition arrears plus interest. If there are no such claims, this section will indicate "None."


§ 6(A.2) – Claims Secured by Real Property to be Paid in Full List all mortgage claims where the intent is not to avoid or surrender and the treatment is to pay the mortgage in full through the plan. Do not list mortgage arrearages as separate claims. For each claim, enter the creditor name, collateral, estimated pre-petition arrearage (if any), pre-confirmation interest rate and dollar amount limit (if any), post-confirmation interest rate, minimum monthly payment, and total payments plus interest.


§ 6(B)(1) – Secured Claims Excluded from § 506 List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle) and the intent is not to surrender or avoid. For each claim, enter the creditor name, collateral, estimated claim amount, pre-confirmation interest rate and dollar amount limit (if any), post-confirmation interest rate, minimum monthly payment, and total payments plus interest. If there are no such claims, this section will indicate "None."


§ 6(B)(2) – Secured Claims Subject to § 506 Valuation List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) and the intent is not to surrender or avoid. For each claim, enter the creditor name, collateral, estimated value of the security or amount owed (whichever is lower), pre-confirmation interest rate and dollar amount limit (if any), post-confirmation interest rate, minimum monthly payment, and total payments plus interest. If there are no such claims, this section will indicate "None."


§ 6(C) – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name and the collateral to be surrendered. If there are no such claims, this section will indicate "None."


§ 6(D) – Lien Avoidance List all claims where the intent is to avoid the lien. For each claim, enter the creditor name, amount owed, and collateral. If there are no such claims, this section will indicate "None."


Part 7 – Executory Contracts and Leases List all lease claims where the intent is to assume. Do not list lease arrears as a separate claim. For each entry, enter the creditor name, property subject to the executory contract or lease, estimated arrearages as of the filing date (if any), minimum monthly payment on the arrearage (if any), number of regular contract payments remaining as of the filing date, amount of regular contract payments, due date of the regular payment, and total payments including arrears and regular payments. If there are no such claims, this section will indicate "None."


Part 8 – Co-signed Unsecured Debts List all claims with a co-debtor attached. For each claim, enter the creditor name, estimated amount due, contract rate of interest, and total amount due including interest. If there are no such claims, this section will indicate "None."
