When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

Part 1 – Above/Below Median Income This section is controlled by the debtor's income relative to the state median.
If the debtor's income is above the median income, the plan will reflect Above Median.
If the debtor's income is below the median income, the plan will reflect Below Median.
Part 2.2 – Plan Payment Method This section is controlled by whether any income source has the box checked for Use for Chapter 13 Employer Withholding.
If no income source has that box checked, the plan will reflect that the debtor will make payments directly to the trustee.
If an income source has that box checked, the plan will reflect that payments will be made via payroll deduction order. The debtor's name, monthly payment amount, and employer name and address will be listed.
Part 3.1 – Maintenance of Payments and Cure of Default List any secured mortgage claims or secured claims with arrearages where the intent is not to avoid or surrender. For each claim, enter the creditor name, collateral or street address, last 4 digits of the account number, post-petition monthly payment, estimated pre-petition arrearage, and arrearage interest rate. Indicate whether the post-petition monthly payment will be paid through the plan or directly by the debtor.
Part 3.2 – Request for Valuation of Security / Cramdown List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, estimated total claim amount from Schedule D, collateral description, fair market value of the collateral, amount of any senior liens, secured claim amount, interest rate, and estimated monthly amount to be paid through the plan. Check the box if the claim is a non-purchase money security interest.
Part 3.3 – Secured Claims Excluded from § 506 List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, last 4 digits of the account number, collateral description, interest rate, and estimated monthly amount to be paid through the plan.
Part 3.4 – Mortgages to be Paid in Full During the Plan List all mortgage claims where the treatment is to pay in full through the plan. For each claim, enter the creditor name, collateral or street address, last 4 digits of the account number, principal balance, monthly payment, interest rate, and indicate whether the post-petition monthly payment will be paid through the plan or directly by the debtor.
Part 3.6 – Surrender of Collateral List all claims where the intent is to surrender. For each claim, enter the creditor name and a description of the collateral.
Part 3.7 – Lien Avoidance List all claims where the intent is to avoid the lien. For each claim, enter the creditor name, collateral description, lien identification details, amount of the lien, amount of all other liens on the same property, value of claimed exemptions, and the value of the debtor's interest in the property. The extent to which the lien is avoided will be calculated from these values.
Part 4.4 – Pre-petition Arrears on Domestic Support Obligations List all domestic support obligation claims. For each claim, enter the debtor's name associated with the obligation, the DSO claim holder name and address, and the estimated arrearage claim amount.
Part 4.5 – Other Priority Claims List all priority claims that are not domestic support obligation claims. For each claim, enter the creditor name and estimated priority claim amount.
Part 5.3 – Maintenance of Payments on Nonpriority Unsecured Claims List any unsecured claims where any of the three long-term treatment options are selected. For each claim, enter the creditor name, last 4 digits of the account number, estimated claim amount, contractual monthly payment, estimated arrearage claim (if any), interest rate on arrears (if applicable), and indicate whether the post-petition payment will be paid through the plan or directly by the debtor.
Part 5.4 – Other Separately Classified Nonpriority Unsecured Claims List any unsecured claims with special treatment, excluding any long-term treatment options. For each claim, enter the creditor name, basis for separate classification and treatment, claim amount, and interest rate (if applicable).
Part 6 – Executory Contracts and Unexpired Leases List any leases. Do not list lease arrears as a separate claim. For each entry, enter the creditor name, description of the leased property or executory contract, indicate whether the intent is to assume or reject, estimated pre-petition arrearage (if any), and how the pre-petition arrearage will be cured.
