When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ I.A – Applicable Commitment Period This section is controlled by the debtor's income relative to the state median.
If the debtor's income is below the median income, the plan will reflect an ACP of 36 months.
If the debtor's income is above the median income, the plan will reflect an ACP of 60 months.
§ III.B.1 – Domestic Support Obligation List any domestic support obligation claims. For each claim, enter the name of the DSO payee, the monthly amount, and the estimated arrears. If the treatment is to pay the claim inside the plan, the Trustee box will be checked.
§ III.B.2.a – Prepetition Priority Tax Claims List all priority tax claims. For each claim, enter the creditor name, estimated amount, and nature of the debt.
§ III.C.1.b – Principal Residence Mortgage Payments and Arrears List any mortgage claims attached to the debtor's residential property where the intent is not to surrender or avoid. Enter the property address at the top of the section. For each claim, enter the creditor name, estimated monthly payment amount, estimated arrears (if any), whether taxes and insurance are escrowed with the lender (Y or N), and whether the treatment is to pay inside the plan (Y or N).
§ III.C.1.d – Non-Residence Mortgage Payments and Arrears List any mortgage claims attached to property that is not the debtor's residential property where the intent is not to surrender or avoid. Enter each property address at the top of its section (Property No. 1, Property No. 2, etc.). For each claim, enter the creditor name, estimated monthly payment amount, estimated arrears (if any), and whether taxes and insurance are escrowed with the lender (Y or N).
§ III.C.1.e – Condominium Association Dues List any claims where "yes" is selected for "Is this for Condo Association Dues?" For each claim, enter the condo association name and address, the property address, the estimated monthly payment amount, and the estimated arrears (if any).
§ III.C.1.f – Prepetition Real Property Tax Claims List any real estate tax liens attached to real property. For each claim, enter the taxing authority, the amount, the delinquent tax years, and an optional equal monthly payment amount.
§ III.C.1.h – Wholly Unsecured Liens List any mortgage claims where the intent is not to surrender, the treatment is to pay in full inside the plan, and the secured balance has been overridden to $0.00. For each claim, enter the property address, creditor name, claim amount from Schedule D, property value, and the balance of all senior liens attached to the same property.
§ III.C.2.b – Secured Claims Subject to Final Paragraph of 11 U.S.C. § 1325(a) List any secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle). For each claim, enter the creditor name, address and account number, collateral, balance owing, interest rate, pre-confirmation adequate protection payment amount (if applicable), and equal monthly payment.
§ III.C.2.c – Secured Claims Subject to 11 U.S.C. § 506 List any secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name, address and account number, collateral, fair market value, interest rate, pre-confirmation adequate protection payment amount (if applicable), and equal monthly payment.
§ III.C.4 – Collateral to Be Surrendered / Executory Contracts to Be Rejected List all claims where the intent is to surrender and where the lien priority is 1. Also list any lease claims where the intent is to reject. For each entry, enter the creditor name and the property or contract description.
§ III.C.5 – Junior Lien Holders on Surrendered Property List all claims where the intent is to surrender and where the lien priority is not 1. For each claim, enter the creditor name, property address, claim amount, property value, and the balance of all senior liens attached to the same property.
§ III.D – Assumed Executory Contracts and Unexpired Leases List all lease claims where the intent is to assume. Do not include lease arrears as separate claims. For each entry, enter the creditor name, address and account number, property description, monthly payment amount, number of months remaining, and cure amount (if any).
§ III.E.1 – Direct Payment by the Debtor(s) List all claims where the treatment is to pay outside the plan. For each claim, enter the creditor name, address and account number, collateral or obligation description, balance owing, and interest rate.
§ III.G – Special Unsecured Creditors List all unsecured claims with special treatment. For each claim, enter the creditor name, the reason for special treatment, and the interest rate (if applicable).
