Chapter 13: Michigan Eastern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ I.B – Limit on Secured Claim Amount This section is controlled by whether you have added any claims under § III.C — Class 3.1.

  • If you have added claims under Class 3.1, the plan will reflect that this provision is Included.

  • If you have no claims under Class 3.1, the plan will reflect that this provision is Not Included.


§ I.C – Avoidance of a Security Interest or Lien This section is controlled by whether you have added any claims under § III.C — Class 3.2.

  • If you have added claims under Class 3.2, the plan will reflect that this provision is Included.

  • If you have no claims under Class 3.2, the plan will reflect that this provision is Not Included.


§ III.C — Class 3.1 – Liens to be Stripped (11 U.S.C. § 506) List all secured claims where the claim treatment is Subject to 11 U.S.C. § 506 (Cram down). For each claim, enter the creditor name and collateral.


§ III.C — Class 3.2 – Judicial Liens and Non-Possessory Liens to be Avoided (11 U.S.C. § 522(f)) List all secured claims where the intent is to avoid the lien. For each claim, enter the creditor name and collateral.


§ III.D — Class 4.1 – Continuing Payments on Principal Residence List all secured mortgage claims attached to the debtor's principal residence where the intent is not to surrender or avoid and the treatment is not to pay the mortgage in full through the plan. For each claim, enter the creditor, collateral, monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is conduit, otherwise use "Direct").


§ III.D — Class 4.2 – Pre-Petition Arrearages on Principal Residence List all secured mortgage arrearage claims attached to the debtor's principal residence where the intent is not to surrender or avoid. For each claim, enter the creditor, collateral, arrears amount, estimated monthly arrearage payment, and number of months to cure from the confirmation date.


§ III.D — Class 4.3 – Continuing Payments on Other Secured Claims List all secured mortgage claims that are not attached to the debtor's principal residence where the intent is not to surrender or avoid and the treatment is not to pay the mortgage in full through the plan. For each claim, enter the creditor, collateral, monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is conduit, otherwise use "Direct").


§ III.D — Class 4.4 – Pre-Petition Arrearages on Other Secured Claims List all secured mortgage arrearage claims that are not attached to the debtor's principal residence where the intent is not to surrender or avoid. For each claim, enter the creditor, collateral, arrears amount, estimated monthly arrearage payment, and number of months to cure from the confirmation date.


§ III.E — Class 5.1 – Secured Claims Not Excluded from § 506 — Equal Monthly Payments List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) and the monthly payment has been adjusted in the Edit Plan Treatment section for the claim. Also include any mortgage secured claims where the treatment is to pay inside the plan. For each claim, enter the creditor and collateral, indicate whether the claim is crammed or modified, the interest rate, total to be paid including interest, monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is pay inside, otherwise use "Direct").


§ III.E — Class 5.2 – Secured Claims Not Excluded from § 506 — Not Equal Monthly Payments List all secured claims where the treatment is Subject to 11 U.S.C. § 506 (Cram down) and the monthly payment has not been adjusted in the Edit Plan Treatment section for the claim. For each claim, enter the creditor and collateral, indicate whether the claim is crammed or modified, the interest rate, total to be paid including interest, estimated average monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is pay inside, otherwise use "Direct").


§ III.E — Class 5.3 – Secured Claims Excluded from § 506 — Equal Monthly Payments List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle) and the monthly payment has been adjusted in the Edit Plan Treatment section for the claim. For each claim, enter the creditor and collateral, indicate whether the claim is modified, the interest rate, total to be paid including interest, monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is pay inside, otherwise use "Direct").


§ III.E — Class 5.4 – Secured Claims Excluded from § 506 — Not Equal Monthly Payments List all secured claims where the treatment is Excluded from 11 U.S.C. § 506 (910 Vehicle) and the monthly payment has not been adjusted in the Edit Plan Treatment section for the claim. For each claim, enter the creditor and collateral, indicate whether the claim is modified, the interest rate, total to be paid including interest, estimated average monthly payment, and whether the payment is made directly by the debtor or via the trustee (use "Trustee" if the treatment is pay inside, otherwise use "Direct").


§ III.E — Class 5.5 – Surrender of Collateral List all claims where the intent is to surrender the collateral. For each claim, enter the creditor name and a description of the collateral.


§ III.F — Class 6.1 – Continuing Lease/Contract Payments List all leases and executory contracts that are being assumed. Do not list lease arrearages as a separate claim. For each entry, enter the lessor or contract holder and the subject of the lease or contract.


§ III.F — Class 6.2 – Pre-Petition Arrearages on Assumed Leases List all pre-petition arrearage claims on assumed executory contracts and leases to be paid by the trustee. For each claim, enter the relevant claim and arrearage details.


§ III.F — Class 6.3 – Rejected Executory Contracts and Leases List all executory contracts and unexpired leases that are being rejected. Any contract or lease not expressly assumed in Class 6.1 will be deemed rejected as of the confirmation date.


§ III.G — Class 7.2 – Domestic Support Obligation Arrearages List all pre-petition domestic support obligation arrearage claims due as of the filing of the Order for Relief.


§ III.G — Class 7.3 – All Other Priority Unsecured Claims List all priority unsecured claims that are not domestic support obligation claims.


§ III.H — Class 8 – Separately Classified Unsecured Claims List any unsecured claims that qualify for separate classification and preferred treatment. For each claim, enter the creditor and describe the treatment.
