Chapter 13: Kansas Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 3.1 – Applicable Commitment Period

  • If the debtor's income is below median, this section will reflect a commitment period of not less than 3 years.

  • If the debtor's income is above median, this section will reflect a commitment period of 5 years and include the total projected disposable income from the means test.


§ 3.3 – Plan Payment Method

  • If the box is selected for "Use for Chapter 13 Employer Withholding" on any income source, this section will reflect an employer-pay order and list the employer's name, address, and the applicable debtor.

  • If no income source has the employer withholding box selected, this section will reflect a debtor-pay order.


§ 7 – Domestic Support Obligations If there are any Domestic Support Obligation claims, this section will reflect that the debtor owes a DSO and list the arrearage in section 7.2. Section 7.4 will indicate whether the arrearage will be paid through the plan by the Trustee or directly pursuant to an existing order. If there are no such claims, this section will indicate "None."


§ 8.2 – Priority Claims Other Than Domestic Support Obligations List any priority claims that are not Domestic Support Obligation claims.


§ 9 – Surrender of Collateral List any claims where the intent is to surrender.


§ 10 – Treatment of Claims Secured by Real Estate This section consists of four subsections:

  • § 10.4: If there are any secured real estate mortgage claims where the intent is not to surrender or avoid and the treatment is to pay conduit or outside the plan, list the claim. If the mortgage is attached to the debtor's residential property, the principal residence box will be checked. Check Trustee if the treatment is conduit and Direct if the treatment is outside the plan.

  • § 10.5: If there are any mortgage claims where the treatment is to pay in full inside the plan and the box is selected for "Subject to 11 U.S.C. § 506 (Cram down)", list the claim.

  • § 10.6: If there are any mortgage claims where the treatment is to pay in full inside the plan and the box is NOT selected for "Subject to 11 U.S.C. § 506 (Cram down)", list the claim.

  • § 10.7: If there are any mortgage claims where the intent is to avoid, list the claim.

  • If there are no claims being added to any of the four subsections, this section will indicate "None."


§ 11 – Debts Secured by Personal Property This section consists of three subsections:

  • § 11.5: List any secured claims not attached to real property where the intent is not to surrender or avoid and neither the 910 Vehicle nor One-Year Loan box is selected.

  • § 11.6: List any secured claims not attached to real property where the intent is not to surrender or avoid and the box is selected for "Excluded from 11 U.S.C. § 506 (910 Vehicle)".

  • § 11.7: List any secured claims not attached to real property where the intent is not to surrender or avoid and the box is selected for "One-Year Loan".

  • If there are no claims being added to any of the three subsections, this section will indicate "None."


§ 13 – Executory Contracts and Unexpired Leases List any leases where the intent is to assume. All other executory contracts and unexpired leases are rejected.


§ 17 – Separate Class Creditors List any unsecured claims with special treatment. If there are no such claims, this section will indicate "None."
