Chapter 13: Illinois Southern District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1 – Payments: Employer Information

  • If any income source has the box checked for "Use for Payroll Deduction," this section will list the debtor's name associated with that income, along with the employer's name, address, city, state, and phone number.

  • If no income source has the box checked for "Use for Payroll Deduction," this section will show the employer fields as blank.


§ 3.A – Ongoing Mortgage Payments by Debtor List any mortgage claims where the intent is not to surrender and the treatment is to pay outside the plan.


§ 3.B – Ongoing Mortgage Payments by Trustee (Conduit) List any mortgage claims where the intent is not to surrender and the treatment is to pay conduit.


§ 3.C – Pre-Petition Arrearages, Limbo Payments, and Post-Petition Arrearages List any mortgage arrearage claims.


§ 3.D – Real Estate Secured Claims Paid in Full List any mortgage claims where the treatment is to pay in full inside the plan.


§ 3.E – Residential Real Estate Subject to § 506 Valuation (Lien Stripping) List any mortgage claims attached to the debtor's residential property where the intent is to avoid. A separate adversary proceeding will be filed to avoid wholly unsecured mortgages listed here.


§ 3.F – Real Estate Secured Claims Subject to § 506 Valuation (Cramdown) List any mortgage claims NOT attached to the debtor's residential property where the box is selected for "Subject to 11 U.S.C. § 506 (Cram down)".


§ 4.A – Secured Claims Not Subject to § 506 (910 Vehicle) List any secured claims where the box is selected for "Excluded from 11 U.S.C. § 506 (910 Vehicle)".


§ 4.B – Secured Claims Subject to § 506 Valuation (Cramdown – Personal Property) List any secured claims where the box is selected for "Subject to 11 U.S.C. § 506 (Cram down)" that are NOT already listed in § 3.F.


§ 4.C – Surrender of Property List any claims where the intent is to surrender.


§ 5 – Separately Classified Claims List any secured claims that are not mortgages, where the intent is not to surrender or avoid, and where neither the 506 nor 910 treatment boxes are selected. If the treatment is to pay inside the plan, payments will be made by the Trustee. If the treatment is to pay outside the plan, payments will be made directly by the debtor.


§ 6.A – Executory Contracts and Unexpired Leases Paid Directly by Debtor List any lease claims where the intent is to assume and the treatment is to pay outside the plan. Do not list lease arrearages as a separate claim.


§ 6.B – Lease Arrearage Payments by Trustee List any lease arrearage claims where the intent is to assume and the treatment is to pay inside the plan.


§ 7.A – Domestic Support Obligations List any Domestic Support Obligation claims.


§ 7.C – Priority Claims List any priority claims that are NOT Domestic Support Obligations.


§ 8 – Long-Term Debts Paid Directly by Debtor List any secured claims where the treatment is to pay outside the plan. If the treatment is paid outside the plan by a codebtor, this will be indicated in the claim entry.


§ 9 – Avoidance of Liens List any claims where the intent is to Avoid. Do not include any claims already listed in § 3.E.
