Chapter 13: Illinois Central District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 4.A – Domestic Support Obligations If there are any Domestic Support Obligation claims, this section will reflect that the debtor is required to pay all post-petition domestic support obligations directly to the holder of the claim, and will list any DSO arrearages to be paid through the plan. If there are no such claims, this section will indicate "None."


§ 4.B – Other Priority Claims If there are any priority claims that are not Domestic Support Obligations, list the claim. If there are no such claims, this section will indicate "None."


§ 5.A – Maintenance of Payments This section consists of two tables:

  • Any secured claims where the treatment is to pay outside the plan will be listed in the first table (debtor pays directly).

  • Any secured mortgage claims where the treatment is to pay conduit will be listed in the second table (Trustee pays). Do not include arrears claims.

  • If there are no claims being added to either table, this section will indicate "None."


§ 5.B – Curing of Default If there are any secured arrearage claims where the treatment is to pay inside the plan, list the claim. If there are no such claims, this section will indicate "None."


§ 5.C – Secured Claims to Which § 506 Valuation is Not Applicable (910 Claims) List all secured claims where the box is selected for "Excluded from 11 U.S.C. § 506 (910 Vehicle)". If there are no such claims, this section will indicate "None."


§ 5.D – Other Secured Claims List all secured claims that are not listed in § 5.C or § 5.A, where the intent is not to surrender or avoid, and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."


§ 5.E – Secured Claims for Real Estate Taxes List all secured real estate tax claims where the intent is not to surrender or avoid and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."


§ 5.F – Surrender of Property List all claims where the intent is to surrender. If there are no such claims, this section will indicate "None."


§ 6.B – Applicable Commitment Period

  • If the case is below median income, this section will reflect a 3-year applicable commitment period.

  • If the case is above median income, this section will reflect a 5-year applicable commitment period.


§ 6.D – Co-Debtor Claims If there are any claims where a codebtor is attached:

  • Claims to be paid in full through the plan by the Trustee will be listed in section i.

  • Claims to be paid directly by the debtor or co-debtor will be listed in section ii.

  • If there are no such claims, this section will indicate "None."


§ 7.A – Executory Contracts and Unexpired Leases – Maintenance of Payments If there are any lease claims where the intent is to assume, list the claim and indicate whether payments will be made by the Trustee or directly by the debtor. If there are no such claims, this section will indicate "None."


§ 7.B – Unexpired Leases – Rejection If there are any lease claims where the intent is to reject, list the claim. If there are no such claims, this section will indicate "None."


§ 7.C – Executory Contracts and Unexpired Leases – Arrearages If there are any lease arrearage claims to be paid inside the plan, list the claim. If there are no such claims, this section will indicate "None."


§ 9.B – Lien Avoidance If there are any claims where the intent is to Avoid, list the claim. If there are no such claims, this section will indicate "None."
