When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1 – Limit on Secured Claim Amount
If there are any claims being added for § 3.2, this section will be marked as Included.
If there are no such claims, this section will be marked as Not Included.
§ 2.1 – Applicable Commitment Period
If the case is below median income, this section will reflect 36 months.
If the case is above median income, this section will reflect 60 months.
§ 3.1 – Maintenance of Payments and Cure of Defaults List all mortgage claims where the treatment is to pay outside the plan. Also include any vehicles with arrearages where the intent is to pay the vehicle outside the plan and to pay the vehicle arrearages inside the plan. Do not list arrears as a separate claim. If there are no such claims, this section will indicate "None."
§ 3.2 – Request for Valuation of Security and Modification of Undersecured Claims (Cramdown) List all secured claims where the secured balance is LESS than the balance on Schedule D, the intent is not to surrender, and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims to be Paid in Full (910 Vehicle) List all secured claims where the balance is the SAME as the balance on Schedule D, the intent is NOT to surrender, and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."
§ 3.4 – Lien Avoidance List any secured lien where the intent is to Avoid. If more than one lien is to be avoided, provide the information separately for each lien. If there are no such claims, this section will indicate "None."
§ 3.5 – Surrender of Collateral List all claims where the intent is to surrender. If there are no such claims, this section will indicate "None."
§ 4.4 – Priority Claims Other Than Attorney's Fees This section consists of two tables:
If there are any Domestic Support Obligation claims, list them in the first table.
If there are any priority claims that are not Domestic Support Obligations, list them in the second table.
If there are no priority claims of any kind, this section will indicate "None."
§ 5.2 – Maintenance of Payments and Cure of Default on Nonpriority Unsecured Claims List any unsecured claims where the treatment is "Long-term claim - maintain payments outside the plan and cure arrearages inside the plan." If there are no such claims, this section will indicate "None."
§ 5.3 – Other Separately Classified Nonpriority Unsecured Claims List any unsecured claims with special treatment. Do not include claims where the treatment is "Long-term claim - maintain payments outside the plan and cure arrearages inside the plan." If there are no such claims, this section will indicate "None."
§ 6.1 – Executory Contracts and Unexpired Leases List any lease claims where the intent is to assume. Current installment payments will be made directly by the debtor and arrearage payments will be disbursed by the trustee. Do not list lease arrears as a separate claim. All other executory contracts and unexpired leases are rejected. If there are no such claims, this section will indicate "None."
