Chapter 13: Florida Middle District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ — Limit on Secured Claim Amount or Lien Avoidance

  • If there are any claims being added for § C.5(d) or § C.5(e), this section will be marked as Included.

  • If there are no such claims, this section will be marked as Not Included.


§ — Lien Avoidance

  • If there are any claims being added for § C.5(e), this section will be marked as Included.

  • If there are no such claims, this section will be marked as Not Included.


§ C.2 – Domestic Support Obligations List all Domestic Support Obligation claims.


§ C.3 – Priority Claims List all priority claims that are not Domestic Support Obligations.


§ C.5(a) – Claims Secured by Debtor's Principal Residence (Conduit) List all mortgage claims attached to the debtor's residential property where the intent is NOT to surrender and the treatment is to pay conduit. Do not list any arrears as a separate claim.


§ C.5(b) – Claims Secured by Other Real Property (Conduit) List all mortgage claims that are NOT attached to the debtor's residential property where the intent is NOT to surrender or avoid and the treatment is to pay conduit. Do not list any arrears as a separate claim.


§ C.5(d) – Claims Subject to § 506 Valuation (Cramdown) List all secured claims where the treatment is 506. If there are no such claims, this section will be left blank.


§ C.5(e) – Liens to be Avoided Under § 522 or Stripped Off Under § 506 List all claims where the intent is to Avoid. If there are no such claims, this section will be left blank.


§ C.5(f) – Claims to Which § 506 Valuation Does Not Apply (910 Vehicle) List all secured claims where the treatment is 910. If there are no such claims, this section will be left blank.


§ C.5(g) – Claims Secured by Real or Personal Property to be Paid with Interest Through the Plan List all secured non-mortgage claims that do not have a 910 or 506 treatment selected, and any mortgage claims where the treatment is to pay in full inside the plan. Do not list any claims that have arrearages. If there are no such claims, this section will be left blank.


§ C.5(h) – Claims Secured by Personal Property – Maintaining Payments and Curing Arrearages List all secured claims that are not attached to real estate and have arrearages. If there are no such claims, this section will be left blank.


§ C.5(i) – Secured Claims Paid Directly by Debtor List all claims where the treatment is to pay outside the plan. If there are no such claims, this section will be left blank.


§ C.5(j) – Surrender of Collateral List all claims where the intent is to surrender. If there are no such claims, this section will be left blank.


§ C.6(a) – Assumption of Leases/Executory Contracts Paid Through the Plan List all lease claims where the intent is to assume and the treatment is to pay inside the plan. Do not list any lease arrears as a separate claim. If there are no such claims, this section will be left blank.


§ C.6(b) – Assumption of Leases/Executory Contracts Paid Directly by Debtor List all lease claims where the intent is to assume and the treatment is to pay outside the plan. Do not list any lease arrears as a separate claim. If there are no such claims, this section will be left blank.


§ C.6(c) – Rejection of Leases/Executory Contracts List all lease claims where the intent is to reject. If there are no such claims, this section will be left blank.
