Chapter 13: Delaware Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ III – Priority Claims In the list below, each box will be checked if there is an amount being listed for that claim type:

  • (A) Debtor's Counsel Fees: Lists the attorney fee balance owed.

  • (B) Priority Taxes: Lists all tax claims, each on a new line with the creditor name, tax year owed, and priority balance.

  • (C) Domestic Support Obligations: Lists all Domestic Support Obligation claims, each on a new line with the creditor name and priority balance.

  • (D) Other Priority or Administrative Expenses: Lists all other priority claims not already listed above, each on a new line with the creditor name and priority balance.


§ III – Secured Claims In the list below, each box will be checked if there is an amount being listed for that claim type:

  • (A) Long term or mortgage debt – pre-petition arrearage only: Lists any mortgage arrearage claims with the creditor name, arrearage balance, and property address. If the treatment is to pay outside the plan, the box for "Debtor shall continue to make regular post-payments directly to creditor" will also be checked.

  • (B) Secured vehicle debt (cramdown): Lists any secured claims where the treatment is 506, with the creditor name, secured balance, monthly payment, asset, and total amortized balance.

  • (C) Secured vehicle debt (910 car claim): Lists any secured claims where the treatment is 910, with the creditor name, monthly payment, asset, and total amortized balance.

  • (D) Other secured debt: Lists any secured claims not already listed in (A), (B), or (C), with the creditor name, secured balance, monthly payment, asset, and total amortized balance.


§ III – Surrender of Collateral If there are any claims where the intent is to surrender, this section will list the creditor name and asset. If there are no such claims, this section will be left blank.


§ IV – Leases or Executory Contracts If there are any lease claims, this section will list the creditor name and the treatment (assume or reject). If there are no lease claims, this section will be left blank.
