When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ I – Valuation of Secured Claim (§ 506)
If there are any claims being added for § 3.2, this section will be marked as Included.
If there are no claims being added for § 3.2, this section will be marked as Not Included.
§ I – Lien Avoidance (§ 522(f))
If there are any claims being added for § 3.3, this section will be marked as Included.
If there are no claims being added for § 3.3, this section will be marked as Not Included.
§ I – Executory Contracts and Unexpired Leases
If there are any claims being added for § VI, this section will be marked as Included.
If there are no claims being added for § VI, this section will be marked as Not Included.
§ 3.1 – Secured Claims That Will Not Be Modified This section covers all secured claims where the intent is NOT to avoid or surrender and where the box is NOT selected for "Subject to 11 U.S.C. § 506 (Cram down)." Claims are handled as follows:
If there are any secured arrearage claims, do not list the arrears separately. Check the box for "There are secured claims where an arrearage will be paid (cured)…" and complete the cure and maintain information for that claim.
If any secured claims are to be paid in full through the plan, check the box for "There are secured claims that will be paid in full through this Chapter 13 Plan" and complete the full balance information for that claim.
If the secured claim is not being modified, check the box for "There are secured claims treated in this Chapter 13 Plan that are not going to be modified" and complete the direct payment information for that claim.
If the claim is attached to real property, check the box for Real Property and then check either Principal Residence or Other. If it is Other, insert the property address.
If the claim is attached to personal property or a vehicle, check the box for Personal Property/Vehicle and add the asset description.
If there are no such claims, this section will indicate "None."
§ 3.2 – Secured Claims Subject to Valuation Motion (§ 506) If there are any secured claims where the box is selected for "Subject to 11 U.S.C. § 506 (Cram down)", list the claim in the appropriate section:
If the claim is attached to real property, add it to the Real Property section. Check Principal Residence if it is the debtor's residential property, otherwise check Other and add the address.
If the claim is attached to a vehicle, add it to the Vehicles section. If the box for "Excluded from 11 U.S.C. § 506 (910 Vehicle)" is checked, select "Claim incurred 910 days or more pre-petition." Otherwise, select "Claim incurred less than 910 days pre-petition."
If the claim is not attached to real property or a vehicle, add it to the Personal Property section.
If there are no such claims, this section will indicate "None."
§ 3.3 – Secured Claims Subject to Lien Avoidance (§ 522(f)) If there are any claims where the intent is to Avoid, list the claim. If there are no such claims, this section will indicate "None."
§ 3.4 – Surrender of Collateral If there are any claims where the intent is to surrender, list the claim. If there are no such claims, this section will indicate "None."
§ 4.4 – Domestic Support Obligations If there are any domestic support obligation claims, this section will reflect that there are domestic support obligations and mark them as "Not Current, and to be paid under this Plan." If there are no such claims, this section will indicate "None."
§ 4.5 – Priority Claims If there are any priority claims other than domestic support obligation claims, list the claim. If there are no such claims, this section will indicate "None."
§ 5.1 – Unsecured Non-Priority Claims If there are any unsecured claims, this section will reflect the total unsecured balance, the dividend percentage, and the plan length. If there are no unsecured claims, this section will indicate "None."
§ VI – Executory Contracts and Unexpired Leases If there are any lease claims, list the claim and check the corresponding box for whether the lease is being Assumed or Rejected. For assumed leases, arrearage payments will be disbursed by the Trustee. If there are no such claims, this section will indicate "None."
