Chapter 13: Colorado Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.3 – Motion for Valuation of Personal Property Collateral (§ 506)

  • If there are any claims being added for § 7.4 (personal property), this section will be marked as included.

  • If there are no such claims, this section will be marked as not included.


§ 1.3 – Motion for Valuation of Real Property Collateral (§ 506)

  • If there are any claims being added for § 7.3, this section will be marked as included.

  • If there are no such claims, this section will be marked as not included.


§ 1.4 – Motion for Lien Avoidance (§ 522(f))

  • If there are any claims being added for § 10.4, this section will be marked as included.

  • If there are no such claims, this section will be marked as not included.


§ 4.2 – Payment Method

  • If there is employment income where the "No Longer Employed" box is NOT checked, this section will reflect employer wage deduction and list the employer's name, address, and phone number.

  • If there is no active employment income, this section will reflect direct payment from the debtor to the trustee.


§ 5.2.A – Domestic Support Obligations

  • If there are any domestic support obligation claims where the treatment is to pay inside the plan, this section will reflect that the arrearage will be distributed by the trustee.

  • If there are any domestic support obligation claims where the treatment is to pay outside the plan, this section will reflect that the debtor is making payments directly or via wage order.

  • If there are no domestic support obligation claims, this section will indicate "None."


§ 6.2 – Class Two A: Defaults on Principal Residence List all secured mortgage claims attached to the debtor's residential property where the intent is NOT to surrender and the treatment is to pay outside the plan. Do not list any arrears as a separate claim. If there are no such claims, this section will indicate "None."


§ 6.3 – Class Two B: Defaults on Non-Residential Claims List all secured arrearage claims that are NOT attached to the debtor's residential property. If there are no such claims, this section will indicate "None."


§ 6.4 – Class Two C: Executory Contracts and Unexpired Leases List all lease claims where the intent is to assume. If there are no such claims, this section will indicate "None."


§ 7.3 – Secured Claims Subject to § 506 (Real Property) List all secured claims attached to real property where the intent is NOT to surrender, the claim is NOT a mortgage, and the secured balance is LESS than the balance from Schedule D, and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."


§ 7.4 – Secured Claims Subject to § 506 (Personal Property and Real Property Paid in Full) This section consists of two tables:

  • In the first table, list any secured claims attached to personal property where the intent is NOT to surrender and the secured balance is LESS than the balance from Schedule D and the treatment is to pay inside the plan.

  • In the second table, list all secured claims attached to real property where the intent is NOT to surrender and the treatment is to pay in full through the plan.

  • If there are no claims being added to either table, this section will indicate "None."


§ 7.5 – Secured Claims to Which § 506 Does Not Apply (Personal Property) List all secured claims attached to personal property where the intent is NOT to surrender, the secured balance is the SAME as the balance on Schedule D, the box for "Subject to 11 U.S.C. § 506" is NOT checked, and the treatment is to pay inside the plan. If there are no such claims, this section will indicate "None."


§ 7.6 – Surrender of Collateral List any claims where the intent is to surrender. If there are no such claims, this section will indicate "None."


§ 10.1 – Direct Payments List any claims where the treatment is to pay outside the plan or paid outside the plan by a codebtor. Do not list claims already listed in § 6.2, § 6.3, or § 6.4. If there are no such claims, this section will indicate "None."


§ 10.4 – Motion to Avoid Liens (§ 522(f)) List any claims where the intent is to Avoid. If there are no such claims, this section will indicate "None."


§ 10.5 – Student Loans

  • If there are no unsecured claims with the consideration marked as Student Loans, this section will indicate "No student loans."

  • If there are any unsecured claims where the consideration is Student Loans, this section will reflect that student loans are to be treated as an unsecured Class Four claim.
