Chapter 13: California Central District Plan Instructions

When you generate your Chapter 13 plan, certain sections are automatically populated with data pulled directly from your case. This article explains exactly how each part of your plan is filled in, so you know how your case information needs to be entered for it to appear in the correct section of your plan.

§ 1.1 – Limit on Secured Claim Amount

  • If there are any claims being added for Class 3B, this section will be marked as Included.

  • If there are no claims being added for Class 3B, this section will be marked as Not Included.


Class 1 – Allowed Unsecured Claims Entitled to Priority This section is inserted in all cases and includes the following:

  • Attorney's fees owed.

  • Internal Revenue Service priority claims, if any.

  • Franchise Tax Board priority claims, if any.

  • Domestic Support Obligation priority claims, if any.

  • Any other priority claims, if any.

  • Any Domestic Support Obligation claims assigned to a governmental unit that will be paid less than the full amount will also be listed in section c.


Class 2 – Claims Secured Solely by Debtor's Principal Residence If there are any mortgage claims attached to the debtor's residential property where the intent is not to surrender or avoid, list the claim. If the mortgage is to be paid conduit, the disbursing agent will be the Trustee. If the mortgage is to be paid outside the plan, the disbursing agent will be the Debtor. If there are no such claims, this section will indicate "None."


Class 3A – Unimpaired Claims to be Paid Directly by Debtor If there are any claims where the treatment is to pay outside the plan or pay outside the plan by a codebtor, list the claim. If there are no such claims, this section will indicate "None."


Class 3B – Claims Secured by Real or Personal Property to be Paid in Full (With Bifurcation) If there are any claims where the treatment is "Subject to 11 U.S.C. § 506 (Cram down)", list the claim. The secured portion will be paid in full through the plan and any amount above the secured value will be treated as a nonpriority unsecured claim in Class 5. If there are no such claims, this section will indicate "None."


Class 3C – Claims Secured by Real or Personal Property to be Paid in Full (Without Bifurcation) List any secured mortgage claims that are not attached to the debtor's residential property and that do NOT have arrearages where the treatment is to pay the mortgage in full through the plan, or any secured claims that do NOT have arrearages where the treatment is to pay inside the plan and where neither the 506 nor 910 option is selected. If there are no such claims, this section will indicate "None."


Class 3D – Secured Claims Excluded from 11 U.S.C. § 506 (910 Vehicle) If there are any secured claims where the treatment is "Excluded from 11 U.S.C. § 506 (910 Vehicle)", list the claim. These claims will be paid in full through the plan with interest. If there are no such claims, this section will indicate "None."


Class 4 – Other Long-Term Secured Claims If there are any secured mortgage claims that are NOT attached to the debtor's residential property where the intent is NOT to surrender or avoid and the treatment is to pay outside the plan or conduit, list the claim. If the mortgage is to be paid conduit, the disbursing agent will be the Trustee. If the mortgage is to be paid outside the plan, the disbursing agent will be the Debtor. If there are no such claims, this section will indicate "None."


Class 5B – Maintenance of Payments on Unsecured Claims List any unsecured claims where the treatment is to pay outside the plan. If there are no such claims, this section will indicate "None."


Class 5C – Separately Classified Nonpriority Unsecured Claims List any unsecured claims with special treatment that is NOT to pay outside the plan. If there are no such claims, this section will indicate "None."


Class 6 – Surrender of Collateral If there are any claims where the intent is to surrender, list the claim. If there are no such claims, this section will indicate "None."


Class 7 – Executory Contracts and Unexpired Leases If there are any lease claims, list the claim and check the corresponding box for whether the lease is being assumed or rejected. For assumed leases, any cure amount will be paid through the Trustee. Any leases not listed here are deemed rejected. If there are no lease claims, this section will indicate "None."
