Virtual Paralegal – Frequently Asked Questions

Written by Sara Taylor

We often receive similar questions from attorneys before they purchase Virtual Paralegal services for the first time. Below are the most common questions, answered clearly for quick reference.

Getting Started

How does onboarding work?
Once you purchase your first case, your assigned Virtual Paralegal (VP) will contact you to schedule an introduction call.

This call is your opportunity to:

  • Discuss workflow preferences

  • Set expectations

  • Review communication style

  • Align on case handling

Assignment & Experience

Will I be assigned a VP familiar with my district?
We carefully match you with a VP who understands your district and local rules.

Working With Your Virtual Paralegal

How does the VP communicate with my client?
Your VP works under your supervision and represents your firm. When contacting clients, they will introduce themselves as your firm’s paralegal, not as an external contractor.

Who manages the VP’s work?
The VP works under your supervision. You are responsible for overseeing their work and ensuring follow-up aligns with your expectations.

Case Handling

What if I need to change the bankruptcy chapter?
If you're unsure whether a case qualifies as Chapter 7 or Chapter 13:

  • Start by purchasing it as a Chapter 7

  • You can switch to Chapter 13 at any time

There is no additional fee to convert the case unless you request help preparing a Chapter 13 plan.

What happens if a case becomes inactive?
If there is no activity for more than 3 months:

  • The VP will request an update on the case.

  • If no response from your firm the VP will place the case on hold.

  • Work resumes once the client provides the necessary information.

How long does it take to complete a case?
Timelines vary depending on how quickly the client provides documents and information.

While VPs actively follow up, delays are most commonly caused by:

  • Unresponsive clients

  • Missing documentation

  • Documents not coming in at the same time causing the means test to need updated

Fees & Billing

Are there additional fees beyond annual package fee?
Yes. The case assignment for one case covers paralegal services only.

Your firm is still responsible for:

  • Software usage fees (per case or annual)

  • Additional services (e.g., credit reports)

  • Chapter 13 plan

  • Post-petition work

Why aren't post-filing amendments included?
Post-petition work (such as amendments or supplemental filings) is not included in the initial case purchase because of the unknown amount of work requested. We commonly see issues with debtors not disclosing information or attorneys approving an incorrect petition.

To request additional work, email:
paralegal@nextchapterbk.com
Include:

  • Case name

  • Description of requested work

What if the client decides not to file?
We do not offer refunds or partial credits.

We recommend waiting until your client has paid in full before purchasing VP services. Since VPs are independent contractors, they are compensated for time already spent on the case.
