All of our Chapter 13 Plans have merge tags that pull information from your case directly into your plan. Each tag has a set of instructions, which describe the logic within the app, so that you can easily understand how this tag is populated. Below is a list of your plan specific tags with their corresponding instructions.
(Hint: These instructions are for the Rhode Island Plan. If you have a district specific plan, you can search the Help Center for the article related to your plan.)
Part 2.
A.
If the case is below median income check: [x] 36 months based on code 11 U.S.C. § 1325(b)(4)(A)(i) instructions
If the case is above median income check: [x] 60 months based on code 11 U.S.C. § 1325(b)(4)(A)(ii)
Part 3.
A. If there are secured arrearage claims attached to the debtor’s residential property where the treatment is to pay inside the plan, add the claim to section 1(a) below.
If there are secured arrearage claims that are NOT attached to the debtor’s residential property where the treatment is to pay inside the plan, add the claim to section 1(b) below.
If there are secured arrearage claims where the treatment is to pay outside the plan, add the claim to section 2 below.
B. If there are secured claims where the treatment is “506”, list the claim in section B(1) below.
If there are secured claims where the treatment is “910”, list the claim in section B(2) below.
If there are secured claims where the intent is “Avoid”, list the claim in section B(3) below.
C. If there are secured claims where the intent is to surrender, list the claim below.
Part 4. If there are no priority claims and/or if the attorney’s fees owed is MORE than $0.00, insert the following.
Insert any domestic support obligation claims in section A below.
Insert any priority claim that is NOT a domestic support obligation claim in section B below.
Insert attorney’s fees owed in section C below.
Part 5. If there are unsecured claims, insert the following.
Insert any unsecured claims that are the result of a secured claim being overridden to a lower amount in section B.
Insert any unsecured claims where the consideration is “student loan” in section C.
Leave the table for section D with one blank row and no claims added.
Insert any claims with special treatment in section F where the consideration is NOT “student loan”.
Part 6. If there are lease claims with arrearages where the intent is to assume, insert the following.
List all leases arrears where the type of lease is Real Estate in section A.
List all leases arrears where the type of lease is Car in section B.
List all leases arrears where the type of lease is Other in section C.
