Include Form 122A/C-2 with no Presumption of Abuse - NJB

How to include Form 122A/C-2 when a presumption of abuse does not arise for your debtor(s) for the district of New Jersey

In the District of New Jersey, local rules or specific trustee requests may require the inclusion of the "Means Test Calculation" (Form 122A-2 or 122C-2) even if a presumption of abuse does not technically arise based on the initial income snapshot.

NextChapter hides "Calculation of Disposable Income" forms by default for below-median debtors since a presumption of abuse does not arise. To override this setting and include these forms, use the following steps:

  1. Navigate to the Means Test Tab > Means Test Questions inside your specific case

  2. Check the box for "Include Form 122A-2 Chapter 7 Means Test Calculation"

  3. Complete the forms using the newly revealed fields in this section.
